Rock mechanics engineers must provide ground support designs that ensure a safe underground working environment. Unexpected falls of ground are unacceptable while ground support systems must be adequate. Ground support must be economic for the area supported and the time frame the opening is in use. While numerical modeling can be used for ground support design, empirical models are still the common useful design tools. Empirical models are best developed and improved from local experiences although some models, such as Stability Graph (Potvin et al, 1992), are in extensive use by the Canadian mining industry. To determine the adequacy of ground support practices at HBMS, a database of 50 fall of ground case histories between 1985 and 2001 was compiled. For each failure, the recorded data included: location, rock type, rock mass conditions, opening and failure geometry, installed ground support and failure mechanism. An analysis of the database was done to obtain an understanding of failure frequency association with rock types, stope geometry and installed ground support, and to assess what support design changes were necessary. The paper describes changes made to ground support and mining practices during the last five years, and the formation of new ground support standards and practices which have been successful in reducing ground falls while providing improved, efficient and economical ground support.

Having been appointed, on February 19th, 1890, a member of the Commission created by the Legislature of Pennsylvania for the purpose of investigating the " Waste of Coal Mining, with the View to the Utilizing of the Waste" (waste in this case referring specially to the small sizes of anthracite heretofore thrown away), my attention was naturally directed to the mash economical method of burning these small sizes.* Although I had been Familiar with the burning of anthracite for • many years, I found when I came to study the matter carefully that I was far from thoroughly understanding it, particularly with reference to the hurning of the smaller sizes, and that the literature of the subject, which was not very extensive, had more of a tendency to confuse than to enlighten me. I began therefore to investigate the subject so as to arrive if possible at some definite principles applicable to the question. With the aid of my assistant, Mr. John R. Wagner, I began at Drifton a series of experiments upon the burning of small anthracites. We first erected a small furnace with a grate 3 feet long and 2 feet wide, with which we experimented about two months. From the information thus acquired, we designed and built another furnace of about the same size, which gave us facilities for extending our investigations still further. After experimenting several months with the second furnace, we built a third one, which was much larger, having a grate area of about 68 square feet, which was exactly the size of the grate used in the boiler-plants of' Coxe Bros. &

THE linear thermal expansions of oriented single crystals of zinc were measured in the range from 20" to 416°C using a Leitz HTV optical lever differential dilatometer. The single crystals, supplied by Dr. J. J. Gilman, General Electric Research Laboratory, Schenectady, N.Y., were prepared from 99.999 pct-purity zinc, and were in the form of rods approximately 2 in. long by 0.15 in. in diameter having the following orientations: x = 1.5, 12, 20, 30, 37.5, 49, 60, 73, and 82 deg where x is the angle between the specimen axis and the (0001) plane of the crystal. From the family of expansion vs temperature curves, the instantaneous expansion coefficients were calculated at 100°C intervals, and Fig. 1 shows a plot of these derived coefficients for each orientation. Coefficients were obtained from the raw data using the chord-slope method. The curves in Fig. 1 indicate a positive temperature coefficient for low x, a negative temperature coefficient for high X, and an expansion coefficient invariant with temperature, amounting to about 43 x 106, for a crystal orientation of approximately 52 deg. From the available data, it is possible to arrive at the values for the axial thermal-expansion coef- ficients a, and a, by extrapolating the curve of the expansion coefficient vs orientation to zero and 90 deg orientations. More precise values for a, and a, are obtained if the instantaneous coefficients are plotted against the square of the cosine of the orientation angle, as shown in Fig. 2. The extrapolated terminal points of the best straight line through the data points of such a plot define the axial coefficients at that temperature. The theoretical justification for the linearity of this curve comes from inspection of a rearranged form of the general anisotropic equation for expansion: ax=a, + (a, -a,)cosZx [1I in which a, is the expansion coefficient in the "c" or [0001] direction and a, the expansion coefficient in the "a" or [ll50] direction. From Fig. 2, the axial coefficients at 100°C, for example, were found to be a, = 13.9 x 10'6 and a, = 62.4 x 10"6 per "C. In the same way, the coefficients were determined for 20", 200°, 300°, and 400°C. This data is summarized in Fig. 3. TOWARD the close of 1925, a British geologist, T. Landell Mills, brought to the notice of .A. Chester Beatty and selection Trust Ltd. certain mineral areas in southern Yugoslavia. Mills' data, which included rough maps and preliminary reports by' a Yugoslav engineer, Jules Draskocy, appeared interesting to Reatty, and early in 1926, I, with three British assistants, proceeded to Serbiaand commenced the investigation of several groups of ancient mine workings. They were found to be extensive and the geological conditions-schists, limestones, and andesitic intrusive-favorable for mineral deposits. At Stan Trg, on the Trepca Concession, five rniles east of Kosovska Mitrovica, an ancient filled adit was found, a shelter-hut erected, and work started in reopening this adit.

The study of self-diffusion of plutonium in E phase has been carried out by the welded couples method. The tracer used was puZ4O which is detected by its X-ray emission (conversion lines of uranium which are computed between 13 and 21 kev). Intensities were measured with a scintillation counter. Each layer was removed in a direction parallel to the original interface with a grinding machine and a thickness measured with a pneumatic comparator. The concentration-penetration curves obtained were corrected for the effect of heating time from room temperature to annealing temperature and for the expansion due to phase transformations of plutonium. They were analyzed by the generalized Gruzin method. Self-diffusion of plutonium in E Phase is very fast cm per sec between 500" and 620°C) and the diffusion zones are 2 to 3 mm wide for annealing times ranging from 30 min up to 10 hr. The Arrhenius law gives the temperature dependence in the form: From the point of view of self-dqfusion, PUE phase falls into the anomalous bcc metals category (Tip , Hfp, Zrp, Uy) with a low-frequency factor and an activation energy lower than those provided by standard correlations. No theory proposed hitherto to explain these anomalies (influence of dislocations, of extrinsic vacancies bonded to inlpurities, of bi-vacancies) can clearly explain the self-diffusion coeffzcients of plutonium. DIFFUSION in bcc metals is a present-day problem. A recent symposium (Gatlinburg, 1964), followed by a book,' has been devoted to it. A great many experiments seem to show that diffusion in certain bcc metals obeys unexpected laws. The activation energies measured are sometimes strangely low (B hafnium, y uranium). For certain metals (0 zirconium, p titanium) the curves of log D (D = diffusion coefficient) as a function of 1/T (T = absolute temperature) are not linear. The frequency factors Do, which are of the order of 1 sq cm sec-' in fcc metals, vary from 1 to 10~6 sq cm sec-'. Various theories have been put forward to explain these anomalies; none is yet satisfactory. We wished to introduce a new experimental result by studying the self-diffusion in c plutonium. This allotropic phase, stable from 475°C up to the melting point (640°C), is in fact bcc. Unfortunately, nothing is known of the characteristics of the point defects in this phase, which limits the scope of the hypothesis which can be made about the mechanism(s) of self-diffusion in plutonium. 1) EXPERIMENTAL METHODS 1) Principle. We used the welded couple method. The two pellets of the couple initially have different 240 isotope contents (X emitter). After diffusion, the concentration/penetration curves are drawn up by the generalized Gruzin method. 2) Gamma Spectrography. The metal used in our study is plutonium, either low in puZ4O (isotopic content 1 pct) or high in puZ4O (8 pct). The latter also contains plutonium 241 (-1 pct) and 300 ppm of ameri-cium produced by the reaction Pu2U-AmM1 + 8-. The emission spectra of these two plutoniums placed in leak-tight vinyl bags have been studied by y spectrograph~. The detector is a thin crystal of thallium-doped sodium iodide. The activity of the plutonium rich in 240 is about twice that of the plutonium low in 240 in the energy band of 17 kev (L conversion lines of uranium); this band was used in these measurements. 3) Preparation and Examination of the Diffusion Couples. Diffusion couples were made from plutonium with a high and low PU"' content. Pellets (6 6 mm. thickness 3 mm) mounted on a polishing disc with ground parallel faces were polished mechanically on both sides. In this way, pellets with two parallel faces were easily obtained. The polished pellets were joined by a 6 phase anneal (420°C, 1 hr) in a small screw press (pressure of 20 kg per sq mm cold); a centering ring enabled the two pellets to be pressed coaxially. The couples then were subjected to the diffusion treatment by annealing in the E phase in sealed silica ampules in argon at atmospheric pressure. The annealing temperatures and times are given in Table I. The couples were encased in a mild steel ring, the joint interface being thus parallel to the ground face of the ring. The diffusion couple/ring assembly underwent successive abrasions by means of a magnetic plate grinder. The thickness of the abraded layer was measured with a Solex pneumatic comparator when it was less than 0.1 mm (accuracy 0.2 p) or with a mechanical micrometer (accuracy 3 p) for passes of the order of 0.2 mm. All these operations were done in glove boxes, as plutonium is particularly toxic. After each abrasion we determined the emission spectrum of the ground face. THe present methods of unloading ore and coarse-crushing at the Magna plant of the Utah Copper Co. are the developments of the pas five years. Hand dumping and breaking have given way to the rotary car dump and large gyratory; and the bucket elevators and stationary screens have been replaced by conveyors and shaking screens. The coarse-crushing plant may be broadly divided into two units the primary crushing and the secondary crushing, or primary roll, unit The former was erected in 1923; with the exception of the excavation the construction was carried on by forces of the company. Excavation was started in the middle of March, the first concrete was poured July 16, erection of the steel building started Oct. 30, and the unit was com pleted and operating Dec. 30. The unit has a capacity of over 24,001 tons of ore per day, and cost more than a million dollars. Remodeling of the primary-roll unit extended over a period of years preceding this some of the work having been done as early as 1918. Delivery of Ore from Mine, Yard Storage, and Handling Ori Cars to and from Primary Crushing Plant The ore is transported, in steel cars of 80 tons capacity, from the min' to the mill, where a reserve tonnage of loaded cars is maintained. Malle locomotives, handling trains of 45 cars, or approximately 3600 tons o ore per train, deliver the trains to a storage yard which contains thre tracks—a passing track and two storage tracks. All of this trackage i equipped with an overhead trolley system, so that electric locomotive can be used in yard switching. The storage tracks have a total length of 4500 ft. and provide storag space for 140 cars. The passing track, besides permitting switchin room for locomotives, is used for storage purposes between train arrivals thus giving intermittently a total storage capacity for the yard of approxi mately 200 cars. FURNACE-MEN who have not taken advantage of the use of dynamite in certain blast-furnace troubles, as explained by Mr. Witherbee in his valuable papers read before the Institute some years since, cannot appreciate the quick relief and great advantage that may be derived at times from its judicious employment. Before giving my experience in the use of high explosives in blastfurnace troubles of certain kinds, I will record a method I have used with marked success in " blowing down." Had I not understood, however, the use of powder, I would have " salamandered " effectually the first time I tried it. Early in my straight-furnace experiments, last summer, at the Chester, N. J., Furnace, I wanted to blow down to within 3 or 4 feet of the tuyeres. To do this with a down-comer not lined, and without putting in any limestone to keep the gases cool enough to do no harm, was not an easy task. We could keep the bell and hopper cool by filling them with water, say 12 inches deep; but before we got the stock down 15 or 20 feet the pyrometer in the gas-flue on top mas up to 1300°, and the clowncomer was red-hot, with the heat still rising. In this emergency my assistant, Mr. N. M. The Metals Mining Sector of the Acid Drainage Technology Initiative (ADTI-MMS) addresses technical drainage-quality issues related to metal mining and related metallurgical operations, for future and active mines, as well as, for historical mines and mining districts. One of the first projects of ADTI-MMS is to develop a handbook describing the best sampling, monitoring, predicting, mitigating, and modeling of drainage from metal mines, pit lakes and related metallurgical facilities based upon current scientific and engineering practices. One of the important aspects of planning a new mine in today’s regulatory environment is the philosophy of designing a new or existing mine or expansion of operations for ultimate closure. The holistic philosophy taken in the ADTI-MMS handbook maintains that sampling and monitoring programs should be designed to take into account all aspects of the mine-life cycle. Data required for the closure of the operation are obtained throughout the mine-life cycle, from exploration through post-closure.

Coal mining in Indiana is limited to the south-western portion of the state, with coal currently being recovered in 19 counties. The coal-producing area of the state covers approximately 6,500 square miles. Although most of the coal in Indiana is recovered by surface mining methods, a small percentage is recovered through underground mining. To date, 40 percent of the known coal reserves have been removed. Indiana has about 33 billion tons of identified coal reserves, of which approximately 17 billion tons are recoverable using current technology. Of this recoverable coal, about 15 billion tons are recoverable by underground mining and 2 billion tons are recoverable by surface mining methods. The State of Indiana has regulated the environmental impacts of coal mining since 1941. Indiana was the second state in the nation to pass legislation requiring mined land reclamation. Its SMCRA regulatory program was approved July 29,1982, and its Abandoned Mine Land Program was approved July 29, 1982.

Introduction It is thirty-odd years since I first entered the mining field by working underground at Anyox, which makes 1t clear that I can qualify as one of the older generation and claim the privilege of dealing in generalities and broad impressions. In this position I find it interesting to re~ view the salient changes that have taken place during the past quarter-century and indulge in some speculations concerning the future, with the hope that my comments may be of value to others engaged in the field of mining geology. As indicated by the title, the treatment is a perspective from a single viewpoint rather than an attempt to give a complete and impartial analysis. This plan, while deficient in some respects, has the advantage of being more specific than one based on .a. compilation of opinions. An additional advantage is brevity, which would be difficult to obtain on a subject of this scope if it were viewed from all angles. In conformity with the general plan, specific references to the literature have been avoided as much as possible, although a number of publications of general nature are listed at the end of the paper. This procedure is intended to give credit to the sources used without making them in any way responsible for the interpretation. The starting point for the discussion is the situation as it existed twenty-five years ago, when, as a recent graduate, I first had a fairly complete picture of it. However there is one impression of an earlier; stage that seems worth mentioning. In one of my first courses in geology the statement was made that some of the leading authorities of the previous generation, who guided geological thought at about the beginning of the century, were inclined to question the value of an association with mining. This attitude was no doubt exceptional, and certainly it was not adopted by the students who laid the groundwork for mining geology in North America. But its existence even in a limited circle is significant m showing how far the application of geology has advanced as the result of the investigations started during the first part of this century.

"Mg-Ni system draws attention due to the promising hydrogen storage properties of Mg2Ni. The proposed method involves the use of NiO and MgCl2 in an electrochemical cell to from Mg-Ni intermetallics directly. The electrodeoxidation of NiO was followed by combination of Mg and Ni in molten salt electrolytes. The products were characterized by XRD analysis and SEM examinations. The quantitative results from Rigaku supported by Rietveld Refinement method conducted by Maud showed that more than 50 percent of the input Ni was converted to Mg-Ni intermetallics.INTRODUCTIONIt is well known that fossil fuels are the most common energy producing materials throughout the last century although, they are not renewable and their usage cause critical environmental problems [1, 2]. Hydrogen, on the other hand, is known as a clean, renewable energy carrier and instead of fossil fuels; usage of hydrogen for energy production will be the benefit of mankind. However, there are problems that hinder more common usage of hydrogen such as hydrogen storage [3]. Mg2Ni is known as Mg based hydrogen storage material with high hydrogen storage capacity [3-6]. Common Mg2Ni production methods are; mechanical alloying [8-11], vacuum induction melting [12, 13], vacuum arc melting [14], combustion synthesis [15], melt spinning [16], repetitive rolling [17] and isothermal evaporation casting [18] were also used. However, in all of these, pure Mg and Ni are required to be produced previously. Therefore, difficulties arise during handling, preparation and combination of Mg and Ni due to highly reactive nature of especially magnesium (i.e. oxidation of Mg) [11, 17, 19, 20]. Although hydrogen desorption dynamics can be significantly improved with usage of nanostructured Mg2Ni [7], it is difficult and it requires very long processing durations to produce nanostructured Mg2Ni by above processes."

INTRODUCTION At the end of the day, the decision by the sponsor to proceed with a project and to seek financing, or the decision by the financier to grant financing are made on a judgmental basis. Cash flow projections, sensitivity and risk analysis, the innumerable ratios applied by the financier, the so-called feasibility study, etc. are all only tools, and the degree to which they affect decisions is as highly varied as are the personality differences and business conduct and outlooks of the persons who render the decision of "go or no-go". The independent consultant, then, is expected to provide an additional increment of credulity and/or reliability to the "tools" which others will use in reaching a decision; the consultant is really not in a position to directly recommend a "go or no-go". PROJECT FINANCE INGREDIENTS The project finance situation has basically three ingredients: - The project; - The inherent risks attendant with project failure; - The parties. The project, to be viable for financing, will have certain essential characteristics, namely: 1. Clear title or rights to the mineral; 2. Proven definition/establishment of mineral quantity; 3. Financial viability; 4. Physical access consistent with financial viability; 5. A market for the product at a price and for the quantity consistent with financial viability; 6. Transportation/shipping from the project facility to the market at a cost consistent with financial viability; 7. Availability and demonstrated expertise of the developer of the facility; 8. Demonstrated expertise of the operator of the facility; 9. Production processes do not involve unproven new technology; 10. Availability of management personnel; 11. The property and the facilities have value (and thus can be used as collateral); 12. Government approvals/support, as required, will have been obtained; 13. The political environment is essentially friendly and stable; 14. The owner(s) of the project have the financial, strength to make equity contributions consistent with total required investment capital and project risk; 15. Backing by credit support other than that of the financier (i.e. guarantees); The inherent risks of failure are (Nevitt, 2nd Edition); 1. Completion delays with consequent delays in the generation of revenue 2. Cost overruns 3. Technical failure 4. Financial failure of contractors 5. Government interference 6. Uninsured losses 7. In 2005, a total of 263 metal mining operations reported employment to the Mine Safety and Health Administration (MSHA). Metal mines were the smallest mining commodity sector, comprising 1.8% of all mining operations. ? Gold mines comprised 46.0% (n=121) of all metal mining operations. Other common types of metal mines were iron ore (n=32; 12.2%), copper ore (n=31; 11.8%), and lead and/or zinc ore (n=16; 6.1%). ? Nevada had the largest number of metal mines (n=52; 19.8%), followed by Alaska (n=27; 10.3%).

Coal has been mined by hydraulic means in various countries, i.e., the hydraulic excavation as well as the hydraulic transportation of coal has been practiced. The hydraulic breaking (excavating) of the coal dealt with in this report is done with a monitor directing a continuous jet of water against the coal, pressures of the water fed to the monitor range from 1500 to 2500 psi at 1000 to 2100 gallons per minute Transportation of the coal from the face is by fluming if a gradient exists in excess of 2 or, when a favorable gradient does not exist, the coal is pumped from the face by various types of pumps which can also provide a means of hoisting the coal to a higher elevation as required. This report presents: 1.) preliminary design and systems specifications of a demonstration miner (referred to in this report as a hydrominer), 2.) mining configurations showing good promise for typical U.S. thick coal seams in three seam pitch categories, (0° - 7° = Flat, 8° - 250 = Moderately pitching, 26° - 90° = Steeply pitching), along with cost and performance analyses for each system, 3.) a definition of a test program that will provide sufficient engineering data for the design of a water jet cutting head adequate to cut coal in those typical U.S. thick coal seams The cost analysis data showed hydraulic methods to be economically competitive with present thick seam raining methods. It was also obvious from studies of thick seam methods that the hydromonitor coal breaking techniques are more effective in removing most of the coal with its long reach of 60 ft. (or more), is a safer mining system, and produces very low coal-dust content in the air (usually less than 0.25 to 0.5 mg/cubic meter). It is recommended that the USBM sponsor a full fledged continuation of the hydraulic mining program: (a) lab, test, (b) preliminary field test, (c) full scale mine section demonstration.

The human race has been exposed to copper for thousands of years, as copper and gold were the metals first used by man (1). if According to Ramazzini (2), "of all the metals that man's ingenuity has contrived to dig out of the bowels of the earth, iron and copper are the most useful, far more so than silver and gold." Workings of copper in the oldest known copper mine associated with the smelting of this metal have been traced back to 4300 B. C. Facts revealed by archeological research in India, Austria, Hungary, France, Italy, and Spain indicate that the use of copper probably began about 5000 B.C. (3), and that about 4000 B.C. a copper age came intermediate between the stone and bronze ages (4). Copper ores are rather widely distributed and are found in nearly every country. Many of the copper minas of Europe have been worked since before the Roman Empire. The must important mines in Europe occur in the district around Huelva, extending into Spain and Portugal. The German deposits are located mainly about Mansfeld (Rhenish Prussia); they have been worked continuously for 1,000 years. Some of the mines in Africa have been worked by the natives for centuries, and China has produced copper from shallow pits for thousands of years. India also has many ancient mines worked in the early centuries (2).

Introduction Pegasus Gold's Montana Tunnels mine is a large surface gold, silver, lead, and zinc mine located 37 km (23 miles) south of Helena in southwestern Montana. Milling operations commenced in late March 1987. The concentrator achieved full production in May that year after undergo¬ing several modifications and improvements. Production for 1988 is projected to be 2.48 t ,80,000 oz) of gold, 34.2 t (1.1 million oz) of silver, along with 8.5 kt (9400 st) of lead, and 22.6 kt (25,000 st) of zinc from lead and zinc concentrates. Mill throughput currently averages 11.7 kt/d (12,900 stpd), compared to the origi¬nally designed capacity of 11.3 kt/d (12,500 stpd). Cash production costs, net of bypro¬duct revenues for the third quarter 1988, were below $3.20/g ($100 per oz). The introduction of ore to the concen¬trator marked the culmination of 12 years ex¬ploration, evaluation, and development. Initial milling operations encountered diffi¬culties with the circuit as designed. As a result, several modifications and improve¬ments were made to the plant. This article is intended to assist other companies developing projects of this type and complexity. It discusses the mine's de¬velopment from feasibility and construction through start-up. The operation, as it exists today, is reviewed including the modifica¬tions and improvements made since start-up. History The mine is situated in Jefferson County, MT within the historic Corbin-Wickes min¬ing district. Underground mining began in 1864 and flourished until the early 1900s. Between 1864 and 1900 the vein deposits in the district produced about $41 million dol¬lars worth of lead and silver ores containing subordinate amounts of zinc, copper, and gold. At various times, three smelters were operated in the area.

(Canal Zone Meeting, November, 1910.) UNDER the title, Labor-Saving Appliances in the Works-Laboratory, I published a paper1 in which was described how multi-manipulations, in a works-laboratory, and in the furnace-room of an assay-laboratory, can be condensed into single manipulations by applying the proper mechanical devices. For example, I now deposit in, or withdraw from, a muffle a set of 48 cupels as one unit. The front row. (8) of these. are blanks or heaters; the other 40, when they have attained the proper temperature in the muffle, are charged simultaneously with the 40 lead-buttons. Three manipulations here accomplish an operation which by the generally customary method requires 136, and this number is only limited by the size of muffle and cupels. This operation is an enlargement of what I have already described in my former paper, and Fig. I shows the improved implements. In the paper referred to I described a gold-silver bead parting-bath, which is the last of the devices used in regular sequence in practice. This bath was designated as being convenient, but was not a labor-saver properly. Fig. 2 of the present paper shows a new device. Instead of the original tray, there are now sectional holders for the test-tubes, each having a wooden handle on either end, so that the holders may be removed from the boiling bath, and the acid or water poured off from each set of tubes (in this case, 7) without waiting to cool. The tubes, held in place by clutches, as shown in Fig. 3, rest in holes in the base-strip, having a smaller diameter than the tubes. Each holder is stamped at either end with a number, so that the bath becomes further useful by permitting several men to use it at the same time without interference. The average quantity of heat needed to refine a barrel of crude oil in 1934 was 638,000 B.t.u., or about as much heat energy as contained in 5 gallons of fuel.oil. Although the total heat utilized in 1934 was slightly above 1933, crude runs to stills increased 4 percent, hence the average requirement per barrel declined from 660,000 B.t.u. in 1933 to 638,000 B.t.u. in 1934 (see fig. 1). The average for 1934 constitutes a new record for firing efficiency, being just under the previous low of 1929. Heat consumption at refineries depends on many factors, of which the trends in yields of gasoline and lubricating oils are probably most important. The yield of gasoline is indicative of activity at cracking plants, which typo of plant utilizes more thou the average amount of heat per gallon of product. The yield of lubricating oils is indicative of the extent to which crude oil is refined; that is, it takes considerably more heat to refine a barrel of crude through lubricating oils than it does to separate only gasoline and kerosene. The yield of gasoline decreased from 43.7 percent in 1933 to 43.4 percent in 1934; on the other hand, the yield of gas oil and fuel oil increased. Although the yield of lubricating oils increased slightly in 1934 the theoretical increase in fuel requirements probably was offset by technical improvements, such as solvent refining. Although no outstanding technical developments of a fuel-saving nature were made in 1934, some progress undoubtedly was recorded. Heat exchangers, an effective fuel-saving device, wore enlarged, and some refiners now take off several cuts before the crude reaches the pipe stills. The total capacity of pipe stills increased 2.5 percent in 1934, and many of the less efficient shell stills were torn out.

In my paper on " End-Lines and Side-Lines in the Mining Law," read at the New York meeting of February, 1889 (Trans., xvii., 787), I discussed certain points involving the rights of a locator, B, who had located and surveyed a piece of ground, X + Y, of which only Y was properly subject to location, X being already held by another claimant, and had applied for and received a patent, granting X + Y, " excepting and excluding X." The paper concluded with the following questions : " Is there any difference in effect between the grant to him of Y simply and the grant of X + Y, ' excepting and excluding X' ? Why should any mining locator stake out his boundaries upon another location, and thus appear to assert a claim which he immediately withdraws? What is the legal force of such boundaries, established upon the land of another?" After calling attention to the fact that the entrance upon another's land for such a purpose is a trespass, and the principle that no trespasser can create by his trespass any right which he would not have without it, I reserved to another occasion a review of the history of the absurd practice of imaginary boundaries for mining claims, and a discussion of their legal effect. This practice is founded, of course, in the regulations and decisions of the United States General Land Office. There is nothing in the Revised Statutes which hints at it. On the contrary, the terms of Section 2322, giving to a locator " the exclusive right of possession and enjoyment" of the surface of his claim, seems clearly to forbid the use of that surface for the boundary-stakes of another locator. But the Act of 1866, though it provided for the issue of patents upon payment to the Government of so much per acre, and really by implication (as I have always believed) involved the absolute grant of the surface, was not so construed by the courts generally, or by the Land Office. Surveys were laid one over another in inextricable confusion, and the United States sold at $5 per acre the
