This study aims to identify individual elements and to gain an understanding of the surface reaction mechanisms, as well as the properties of precipitated pyrite particles observed during the hydrothermal formation of an ore deposit. A combination of X-ray diffraction (XRD), air annealing in a furnace, scanning electron microscopy/energy-dispersive X-ray spectroscopy (SEM/EDX), and X-ray photoelectron spectroscopy (XPS) was applied to investigate the crystal structure and identify the individual elements, permanence, transformation and chemical/electronic properties of such pyrite.

Loading shovels are at the heart of most surface mine production. As truck sizes have increased, shovel manufacturers have matched them with larger shovels (see table, page 343). Further increases in shovel size may be in order if trucks in the 270-t (300-st) range find acceptance at the largest surface mines. However, larger shovels are not currently the primary focus of shovel design engineers. Competition and user pressure are combining to keep their work directed toward improved shovel productivity and efficiency. Computer design technology and advanced electronics play an increasingly prominent role in this work. "Improved diagnostic capability, system monitoring, vibration analysis and above all increased user friendliness in machine control systems are being pursued by most manufacturers working in our industry today," observes Stuart R. Cotterill, director of marketing for Harnischfeger Corp. The use of computer-aided design (CAD) systems in shovel design has been in place for many years. However, recent advances in computer capability and improved software programs and graphics are making computers even more useful.

At the RETC 1979 in Atlanta/Georgia it was reported about the beginnings of the Hydroshield system and the first site experiences. Since that time over 10 miles of tunnels in various diameters have been built with that system, and the discussion of the two most interesting projects will be the main topics of this paper. AURELIA TUNNEL, ROME In Rome, the railway system is going to be completed and modernized. Therefore, it is necessary to tunnel through the Roman hills. Part of the new railway system is the Aurelia Tunnel, located some 100 feet below the famous Via Aurelia Antigua, close to the Vatican. The double track railway tunnel has an internal diameter of 9.44 m and a length of 2.410 m. It runs through completely differing soil conditions. The amount of energy used to break rock is of interest in mine-to-mill operations to minimize energy consumption during blasting at the mine site and comminution at the processing plant. In this research, a direct energy measurement was made using high-velocity impact to cause breakage of long granite cores, and to study the energy dissipation along the entire bar length. The results show the formation of three zones of damage — fragmentation, fracture and elastic — that have been characterized in 3D using X-ray tomography. The fragmentation zone of the granite bars was studied in detail to describe the particle size distribution and the particle shape characteristics. The experimental energy dissipation in the fragmentation zone was found to be in close agreement with the expected energy calculated from the Bond work index (BWI) equation [1] when the anisotropic granite particles in the fragmentation zone are defined by length rather than by sieve size. The results increase our understanding of rock breakage and energy consumption and may find future applications in mine-to-mill operations.

At our annual meeting in St, Louis, Mo. in February 1961, we presented a comprehensive paper (No. 61-B-22) on the subject of "Blending and Handling of Materials for Agglomeration". In that paper you will find a discussion on the difference between "blending" and "mixing". With regard to "blending" we brought out the facts of its usefulness for the preparation o materials in an agglomerated mass to attain controlled chemical and physical uniformity. "Mixing" was discredited as not being useful for the attainment of uniformity of any kind.

In oil sands mining, tailings are voluminous unwanted byproducts generated from extracting the desired mineral from the mined ore. Dyke construction and backfilling activities require well-managed techniques to facilitate progressive reclamation at the earliest opportunity. This directly affects the sustainability and profitability of the mining operation. This research introduces a goal programming framework that simultaneously optimizes the (1) production schedule with limited duration stockpiling and directional mining, (2) dyke construction schedule, (3) size, shape and location of tailing cells and (4) mining and processing production targets. The results show that in creating in-pit tailing-cell designs, decreasing the mining-cell volume and increasing the number of mining cells improves the net present value (NPV) of the operation due to increased operational flexibility.

Mineral models provide a systematic and comprehensive approach for analyzing and fore- casting the behavior of mineral markets and industries.' They also permit the analysis of a wide range of policy decisions. Obviously such models cannot capture all of the intricate relationships that shape the behavior of a mineral market. However, such models have become extremely useful and in many cases support the decision making approach of judgmental analysts. They tend to narrow the range of likely outcomes and thus reduce the risks and uncertainties of investing, trading, and speculating in minerals. Mineral models provide not only answers to "what-if" questions, they also inform analysts of the benefits and costs associated with mineral investment decisions. More recently they have been applied to specific mineral issues of the possible impact of buffer stock stabilization schemes and of import supply restrictions. Mineral Models Defined Because mineral models are so diverse, we must begin with a fairly broad definition. A mineral model is a formal representation of a mineral market, industry or system where the behavioral relationships included reflect the underlying economic and engineering factors as well as the political and social institutions. Of ten, but not always, a mineral model will consist of some combination of the following components: demand, supply, inventories and prices. Modeling of demand behavior normally begins with an interpretation of basic demand responses to prices and income (i.e., the associated price and income elasticities). Price elasticities vary among different minerals and among their diverse uses. They tend to be lower for minerals without close substitutes than for those where such substitutes exist. In addition, these elasticities vary with time as well as with the actual excess demand or excess supply. Variations like these, coupled with the relative instability of prices for a number of minerals, make explanations of demand behavior difficult. The degree to which demand responds to changes in income depends on the income elasticity of the end products to which the minerals serve as inputs. Those products with a relatively low income elasticity tend to experience proportionally smaller swings in sales than those with higher elasticities. The transmission of demand cycles to minerals producers comes through a series of stage-of-process effects. Demand measurement also is influenced considerably by mineral substitution patterns. The cross-price elasticity of a competitive or complementary commodity also varies with minerals, markets, and time. Where minerals easily substitute for one another, as in the case of cop- per and aluminum in electrical conductor applications, cross-price elasticities are relatively high. The closure of TSF represents a critical milestone in the life cycle of mining operations, requiring the integration of technical, environmental, and social dimensions to ensure long-term safety and sustainability. The GISTM introduces the concept of “safe closure” as a demonstrable technical condition in which there are no ongoing material risks to people or the environment. This status must be validated by an independent technical reviewer and formally approved by the Accountable Executive. This article presents a risk-based methodology to support the achievement of safe closure, aligned with the principles and requirements of the GISTM. The proposed approach emphasizes the need to identify, assess, and manage closure and post-closure risks progressively throughout all phases of the TSF life cycle: from site selection and design, through construction and operation, to closure implementation and long-term monitoring. The methodology integrates key elements of effective risk management, including comprehensive knowledge bases, consideration of climate change, credible failure modes, continuous monitoring, stakeholder engagement, and governance. The ALARP principle is applied to demonstrate that residual risks have been reduced to tolerable levels. By incorporating closure planning from the earliest stages and adopting a risk-based view throughout the entire life cycle, this methodology aims to support mining organizations in achieving a verifiable and responsible closure of tailings facilities, in line with international best practices such as those of ANCOLD and ICOLD. The proposed framework offers a practical contribution to strengthening the credibility, effectiveness, and sustainability of tailings closure processes.

"Estimation of rock drillability is vital for mining and boring operations. For this purpose, many researchers have developed various models and equations to estimate rock drillability. Most of these models aim to determine the drillability of rock and the penetration rate by using the physical and mechanical properties of rocks. Although drillability primarily depends on rock properties, other parameters have an impact on drillability as well. One of these parameters is the rotation speed of the bit. This study investigates the effect of rotation speed of the bit on drilling performance. Drilling tests were performed in the laboratory using rotary core drilling and a diamond drilling machine. The relationships between the physical rock properties and the penetration rate were investigated on 15 different rock types and four different rotation speeds were applied to determine the effect of rotation speed of bit on drilling. The uniaxial compressive strength, density, and P wave velocity show strong correlations with the penetration rate. In addition, if the values of the physical and mechanical properties of the rock increase, the effect of the rotation speed on the penetration rate decreases, i.e., increasing the rotation speed of the bit slightly affects drillability on hard and solid formations. 1. Introduction Drilling is one of the most essential operations in the mining industry, beginning from the exploration phase and continuing throughout all stages of production to the end of mine life (Taheri et al. 2016). In addition, drilling is widely using in the construction industry and other engineering operations. Various drillholes (blastholes, injection holes, borehole, diamond wire holes in natural stone mines, etc.), are needed during development and production activities in underground and open-pit mines as well as in dam, tunnel, road construction and sewage systems. For effective drilling operations, it is first necessary to gather information about the formation to be drilled. Drilling should then be performed after selecting appropriate drilling equipment and drilling parameters (thrust, pressure, rotational speed, flushing). Prediction of the drillability of rocks is vital for planning and performing the drilling process. Although, drilling is affected by several factors, the most important ones are related to the geological and mechanical properties of formation (Protodyakonov 1963, Paone et al 1969, Tandanand and Unger 1975, Pathinkar and Misra 1976, Rabia 1985, Perrin et al 1977). Determining the penetration rate is vital for planning a project and calculating the operation costs. The prediction of drilling affects the selection of drilling equipment, the efficiency of drilling equipment, project costs and the process of drilling operations."

PotashCorp?s Aurora phosphate mine, in Beaufort County, NC, operates four low pressure boilers and four high pressure boilers to meet its process steam requirements. Maintaining these boilers is critical to meeting production demands. Processing phosphate ore into phosphoric acid requires large amounts of sulfuric acid and steam. Ore is mined from the phosphate deposit with large bucket excavators after 9 to 30 m (30 to 100 ft) of overburden is removed. The phosphate ore is mixed with water to make a slurry that is pumped to the mill. Elemental sulfur is burned in the presence of air to make sulfuric acid. This process is highly exothermic and boilers produce steam while cooling the process. The phosphate ore is reacted with sulfuric acid and the resulting products are refined into different grades of phosphoric acid for fertilizers, feed stock and food additives. Plant operators at the mine were challenged with boiler feed water that was high in silica and other contaminants. As a result, boiler operations were experiencing difficult, labor-intensive operations and equipment deterioration. This resulted in higher operating costs and diminished processing performance. The facility was operating an aged boiler feedwater pretreatment system that included warm lime softening followed by pressure filtration and a cation/anion/mixed bed demineralizer system. The demineralizer required frequent regeneration and chemical usage was high and costs were difficult to predict. Depressurized well water (DPW water), used for plant utility water and boiler makeup, is very high in silica, in the range of 60-70 ppm. Silica can form scale at pressures below 600 psig. Above 600 psig, silica starts to volatize, carrying over with steam to potentially form deposits on downstream equipment and processes. Mine officials decided to upgrade the boiler feedwater pretreatment system to a state-of-the-art reverse osmosis (RO) membrane system. This new system, which started up in March 2009, has improved operating performance and reduced water consumption and overall operating expenditures.

"Efforts have been tried to apply the mixture of mine tailings and fly ash as construction materials. Through the present investigation, a protocol to make construction materials using the mixture of mine tailings and fly ash has been set up. The experiment results of the present work also help set up the working conditions such as activation temperature and time, the concentration of NaOH, the addition of Ca(OH)2, forming pressure, mine tailing to fly ash weight ratio, curing temperature and curing time. The findings of the present work provide a novel method for the geopolymerization of the mixture of mine tailings and fly ash as construction materials, such as bricks for construction and road pavement. INTRODUCTION In mining activity, after the valuable materials are extracted from ores, millions of tons of solid rejects, i.e., mine tailings, are stored in the tailings dam, which occupies a huge area of land and leads to high monetary, environmental and ecological costs. For example, the impoundment of mine tailings can bring with serious environmental problems such as mine dust and tailing dam failure. On the other hand, the making of general construction material results in a lot of greenhouse gas emission. Therefore, it is of great interest to utilize mine tailings, for which a lot of energy has been consumed during the comminution process, as construction materials using the novel geopolymerization technique. (Xu and van Deventer, 2000, 2002a, 2002b; Pacheco-Torgal et al., 2007, 2008; Zhang et al., 2011; Ahmari et al., 2012) Fly ash is another industrial waste which needs to be carefully impounded because of its potential impact on environment. Many efforts have been tried to utilize fly ash as construction materials because it is a silica/alumina rich aluminosilicate source. In addition, the facts that fly ash is quite reactive to alkali and its particle size is usually very small (< 50 microns) make the specific material an ideal source for the geopolymerization process to make construction materials. Geopolymerization is a process of obtaining a polymeric structure from aluminosilicate by dissolving aluminosilicate sources in a strong alkali (NaOH) solution at an elevated temperature. After being cured at an elevated temperature for a specific time, the geopolymerization product shows a greatly increased compressive strength. Therefore, the product can be used as construction material such as bricks and road pavement. It provides a very promising method to apply aluminosilicate sources such as mine tailings and fly ash as construction materials."

The increasing volume of wastes being generated by industry is a legacy of the industrial revolution and subsequent industrial growth. Social and regulatory pressures have been mounting on industry to improve its waste management practices. In many industrial sectors, waste disposal has been the only method of waste management. Land farming, underground burial, deep wells and incineration are still practiced. Often, concentration and volume reduction of waste streams are also practiced to reduce the waste management costs. In the recent years, there has been emphasis on waste minimization. Since the 19th century, industry has practiced recycling of usable resources as a way of handling unwanted byproducts. The mining industry has recovered or extracted economic minerals from tailings for decades. For example, during the gold rush period of 1970s, extraction of gold from tailings dams became economically attractive. Similarly, when it was economical, coal and shale fractions have also been recovered from tailings and refuge materials for commercial uses. In the steel industry, with the development of new furnace technology, recycling of flue dust and scrap iron was practiced as early as in the 19th century. Before 1900, there was little incentive for the industry to reduce the waste volumes. Manufacturers, however, did see a rationale for adopting profit-increasing techniques. They made an effort to recover and recycle economic materials from waste sources. One of the pioneering examples of resource recovery is the coke making industry. As the industry was market driven, products recycled from coke batteries included ammonia for use in fertilizers, gas for power generation and heating, and tar for road construction, wood preservation and roofing. Tar had been avery troublesome waste byproduct. But it quickly became a valuable chemical raw material, providing the foundation for Germany&apos;s dominance of the world&apos;s dye and medicine markets before World War I. Similar trends evolved in the chemical industry. In the context of current environmental regulations and escalating mining and processing costs, recycling of re- [ ] sources is becoming economically more attractive. Solid and liquid wastes generated by industries contain a range of inorganic and organic contaminants. Among these contaminants, metals and hydrocarbons form major groups. Treatment of these wastes is essential to meet regulatory disposal requirements. In the recent years, based on the principles of chemical and mineral process engineering, processes have been developed to treat these industrial wastes. This article reviews some of the processes that have made impacts and have proven to be effective at commercial scales.

Techniques for optimization of mineral processing flowsheets are reviewed. Though not yet widely used in the minerals industry, approaches for chemical process optimization based on successive quadratic programming (SQP) algorithms may be employed to determine optimum unit design and control settings for a mineral processing flowsheet. Moreover, in certain mineral processing flowsheet applications, specialized techniques can be applied because of the nature of the system relations. These techniques offer advanta es in efficiency. Moreover, their capability exceeds that o f the SQP approaches since simultaneous optimization of circuit configuration and unit controls can be addressed.

INTRODUCTION Since the first introduction of explosives into mining operations, safety considerations have prohibited the use of machinery in association with the explosives. Only within the last 25 years has this situation changed appre¬ciably; the closest thing to "machinery" used by a powderman in the "old days" was his wooden tamping stick. With the blackpowder and dynamite used during the first 150 or so years of mining blasts, substituting a drill steel or a metal "spoon" invited serious disaster. With the advent of ammonium nitrate-fuel oil (ANFO) explosives (1950s) and water-gel explosives (1970s) for underground blasting, machinery started to play a large part in blasting procedures. The lower sensitivity of ANFO and water gels allows these prod¬ucts to be loaded in a variety of safe ways. Not only has this meant cost savings in labor and blasting materials, but it has also resulted in whole new mining concepts where the limitations of dynamite previously made those concepts uneconomical, impossible, or excessively risky. Increasingly (totally for some mines), the traditional tamping stick has given way to a variety of pneumatic machines for loading explosives and blasting agents. The resulting blasting operations have become safer, more efficient, less uncomfortable for personnel, and a major step forward in mining technology. ANFO LOADING EQUIPMENT Three basic types of loaders are used for ANFO explosives, these being the pressure-vessel loaders, Venturi loaders, and combination loaders. Pressure-Vessel ANFO Loaders ANFO consists of prilled ammonium nitrate (porous pellets I to 2 mm in diam) and fuel oil in the appro¬priate 94 to 6% blend. The material is fairly dry, pourable, and easily conveyed by an air stream. One device or system for handling (hole loading) ANFO is the pressure-vessel loader. ANFO is dumped into the vessel or "pot," and the vessel then is pres¬surized. The ANFO is conveyed out of the bottom of the vessel into a semiconductive hose that has been inserted into the blasthole. Fig. 1 illustrates a typical pressure-vessel loader in use. Applications: The use of pressure-vessel loaders is widespread in room-and-pillar mines, including salt, potash, trona, lead, and other rubber-tired mines where the heavy pressure vessels can be mounted on a vehicle for transport from face to face. The vessel often is large enough to hold eight or more 23-kg (50-1b) bags of ANFO, so several faces can be loaded before refilling. Petromineralogical studies of late Paleocene–middle Eocene phosphate nodules in the Subathu Basin of Solan District, Himachal Pradesh

A nano-scale investigation has been carried out by applying an AFM (atomic force microscope) to study in situ the adsorption of various collectors, i.e., oleic acid, octanohydroxamic acid (HA), and salicylhydroxamic acid (SHA), on bastnaesite in aqueous solutions. The obtained AFM images show that the surface morphology of bastnaesite changes greatly after it contacts the solutions of the collectors, suggesting that all these collectors can effectively adsorb on bastnaesite. Increasing temperature can help increase the adsorption of oleic acid on bastnaesite. FTIR (Fourier transform infrared) results also show that all these collectors adsorb strongly on bastnaesite with a strong absorbance spectra being detected, which confirms with the results obtained with AFM imaging analysis. In general, hydroxamic acid collector (HA and SHA) adsorbs on bastnaesite mainly in the form of insoluble metal hydroxamate. This specific adsorption mechanism explains that a high selectivity with a moderate collectivity will be achieved with a hydroxamic acid collector for the flotation of bastnaesite. INTRODUCTION Rare earth metals, which are very important to modern industry, are generally extracted from numerous rare earth minerals. In practice, however, the actual extraction of rare earth is mainly from bastnaesite, monazite and xenotime. The Mountain Pass mine is one of the largest rare earth mine in the world, at which the main rare earth mineral is bastnaesite. In the past years, froth flotation has been applied to the beneficiation of Mountain Pass ore. In practice, the rare earth ore is usually crushed, milled and further separated from calcite, barite and other gangue minerals by froth flotation, in which the rare earth oxide-bearing minerals stick to aerated bubbles in the pulp and float to the surface, leaving the gangue at the bottom of the flotation cell and disposed of as tailings.(Bulatovic, 2010) In spite of the fact that froth flotation has been applied to treat the bastnaesite ore at the Mountain Pass mine, the rare earth oxide (REO) recovery is still low,(Anderson, 2015) especially compared to the one obtained with sulfide flotation. For example, the typical recovery obtained at the Mountain Pass mine was only about 70%. This may be due to the low selectivity of the collector (oleic acid). In addition, to enhance the flotation selectivity, the pulp in the mine circuit has to be heated up to 70 to 90°C and it involves a lot of energy consumption. Last but not the least, a lot of depressants have to be added to improve the selectivity of flotation process. Therefore, it is critical to re-examine the existing flotation process at the Mountain Pass mine and seek any chance of improvement. (Anderson, 2015)

O2, NaCl03, H202, NaOCI and Ce+4 have been examined as oxidants in an alkaline carbonate system for uranium in situ leaching. The South Texas and New Mexico ores contained up to 2.6 meq/g of reducing compounds that consume oxidants in the leaching operation. Leaching rates did not increase linearly with the oxidation potential of the oxidants. A mild oxidant can be used to maximize uranium oxidation selectivity and oxidant efficiency. 02 can oxidize most of the uranium mineral with an adequate rate and high oxidant efficiency.

"The performance of column flotation is strongly influenced by the effectiveness of the gas sparging system. Unfortunately, field studies suggest that gas injector systems used for column sparging are not always optimized. This unfavorable condition can create a number of issues within the concentrator including lower recoveries, poorer metallurgical upgrading, decreased capacities, increased circulating loads, higher reagent consumption and inefficient energy usage. To help overcome these problems, techniques have been developed that can be adopted by plant operators to improve sparger performance. These techniques include (i) design modifications to sparger components such as nozzles, distributors and internal parts and (ii) operational improvements such as proper balancing of gas/water flows, elimination of unnecessary pressure drops, and staged injection of frothing agents. This article reviews the important criteria that govern sparger operation and provides data showing how simple low-cost improvements can positively impact column performance. INTRODUCTION Column flotation cells have become the most popular machine design for industrial applications that require high purity concentrates. The superior metallurgical performance of column cells can be largely attributed to their unique geometry, which readily accommodates the use of froth washing systems. The wash water minimizes the nonselective entrainment of ultrafine gangue minerals that would otherwise be hydraulically carried in the water reporting to the froth concentrate. The larger height-to-diameter ratio of columns allows a deep froth to be maintained, which is essential to achieve even water distribution. Due to these unique features, column cells can provide impressive levels of metallurgical performance closely approaching the ultimate separation curve predicted using the flotation release analysis method (Kohmuench et al., 2007). Another very important feature of column cells is the design of the gas sparging system. One popular choice in the minerals processing industry is the Eriez SlamJet® sparger. As shown in Figure 1, this type of sparger operates by passing compressed gas through a small discharge nozzle. Fluid turbulence created by the exiting gas disperses and distributes small bubbles into the flotation pulp. The sparger is equipped with an internal moveable rod that is attached to a pressure diaphragm in the back housing of the sparger. The internal rod automatically moves back/forward and opens/closes the nozzle outlet when the compressed gas is switched on/off. This patented design effectively eliminates the accidental backflow of flotation pulp into the injection tube during shutdowns. The sparger can be operated as a gas-only injector or with the introduction of a small amount of high-pressure sparger water (Kohmuench et al., 2010)."

Progressive Design-Build (PDB) is an emerging variation of alternative delivery programs in the underground construction industry. PDB refers to the way a construction project design is developed by the Owner and the Design-Builder in a step-by-step process. According to the Design-Build Institute of America (DBIA), Progressive Design-Build allows the design and construction team to collaborate during the earliest stages of project development. This enables engagement between the three key players in a construction contract: the owner, the designer, and the contractor. Is the PDB the best alternative program delivery for large contracts? What is the perspective of the private sector? This paper will provide an overview of the different alternative delivery programs used in the underground industry, pros and cons of each of programs, and the perspective of the designers and contractors. The paper will focus on how the PDB works, reasons why owners should consider PDB for their projects, best collaboration strategies among owners, designers, and contractors to deliver a successful project, and how to manage the project risks using a PDB method.

Introduction The Surface Mining Control and Reclamation Act (Public Law 9587) (hereinafter the "Act" or "SMCRA") passed by Congress in August 1977 represents a comprehensive federal scheme for controlling surface coal mining and the surface effects of underground mining through permitting requirements, performance guidelines and reclamation planning. While the provisions of the Act have been the subject of numerous legal challenges and court battles over the years, it is difficult to identify a more controversial program within the Act than the provisions for designating lands as unsuitable for surface coal mining operations. The lands unsuitable designation process provides for the acceptance and review of petitions submitted by citizens or organizations seeking to have specified land areas designated unsuitable for all or certain types of surface coal mining activities. In filing these petitions, the interested parties or petitioners are required to make allegations about potential adverse impacts on people or the environment and submit evidence supporting their allegations. In 30 U.S.C. § 1272, Congress provided that "[a]ny person having an interest which is or may be adversely affected shall have the right to petition ... to have an area designated as unsuitable for surface coal mining operations." Under the Act, an area can be designated as unsuitable where the mining operation will (1) be incompatible with existing state or local land use plans, (2) affect fragile or historic lands, (3) affect renewable resource lands where mining operations could result in substantial loss or reduction of long-range productivity, or (4) affect natural hazard lands where such operations could substantially endanger life and property. In enacting SMCRA, Congress mandated that each state establish a process to determine which, if any, lands within the state are unsuitable for all or certain types of surface mining operations. In response to this federal legislation, the Kentucky General Assembly adopted a state regulatory program for surface mining that included provisions direct¬ing the Secretary of the Natural Resources and Environmental Protection Cabinet to establish a program for designating lands as unsuitable for surface mining as required by the Act. In recent litigation in Kentucky, several environmental groups filed a lands unsuitable petition, later joined by the University of Kentucky, challenging a proposal by Arch Mineral Corporation to surface mine over 3 million tons of recoverable coal. The petition sought to designate over 10,000 acres of land adjacent to Arch&apos;s proposed operations as unsuitable for surface mining operations, basically alleging that the mining would disturb an outdoor laboratory. The filing of the petition activated Kentucky&apos;s regulatory scheme for reviewing lands unsuitable petitions that can result in an absolute prohibition against surface mining on the petitioned land for historical, environmental and other related reasons. The designation process involves vague petition requirements creating a situation that Arch argued is devoid of constitutional due process and subject to abuse by the petitioner on many fronts. Arch maintained that the lands unsuitable regulations do not grant adequate protection to Arch&apos;s legitimate property rights under the due process clauses of the United States and Kentucky Constitutions and are thus void and unenforceable. The entire process resulting in a decision on the petition took just under 12 months in the Arch case, and although Arch was ultimately successful in preserving its right to mine, Arch&apos;s surface mining permit was held up for this period of time. This delay led to the cessation of mining operations by Arch and the idling of over 250 workers. This paper will review the lands unsuitable designation process and the significant implications the process has for existing surface mining operations, currently proposed operations and even those long-range operations not yet contemplated. Special emphasis will be given to Kentucky&apos;s lands unsuitable program. Finally, the recent litigation involving Arch Mineral Corporation and its effort to surface mine 81.5 acres of Arch controlled property will be utilized to illustrate this very unusual regulatory scheme. Regulatory background Chapter 30, Subchapter F of the Code of Federal Regulations (C.F.R.) promulgated to implement the provisions of SMCRA, requires that each state establish procedures under the state&apos;s surface mining program for designating non-federal and non-Indian state lands as unsuitable for all or certain types of surface coal mining operations. 30 C.F.R. § 764.1. The C.F.R. establishes minimum standards for state lands unsuitable programs and sets out requirements for filing a Lands Unsuitable Petition (hereinafter "LUP"), processing LUPs, decision-making guidelines and hearing requirements. Kentucky has adopted regulations providing for the implementation of the lands unsuitable process as part of the state&apos;s regulatory program under SMCRA. The following discussion summarizes the principle components of the Kentucky lands unsuitable program.
