The Mineral Resources Institute (MRI) of the School of Mines and Energy Development (SOMED), University of Alabama conducted studies to determine the potential for upgrading the Eastern Devonian shales by flotation. Results of those studies indicate that flotation concentrates containing 150 liters of oil/t (36 gal/t) can be produced from shale containing 50 liters of oil/t (12 gal/t) as determined by Fischer Assay with good recovery of the kerogen. Organic carbon and trace elements such as molybdenum, vanadium and uranium also are concentrated with the kerogen. Kerogen concentration was found to be a function of the size of grind.

INTRODUCTION The rock mechanics study of the shortwall mining system at Beth-Elkhorn corporation's Hendrix No. 22 Mine is being conducted under contract with the U.S. Bureau of Mines. The objective of the study is to obtain data on surface subsidence over a portion of the mined area, strata subsidence in the mined area, and underground stress changes and displacements in and near natural support elements of the mining system. This study is currently in progress, and only a portion of the results are being presented at this time. The Hendrix No. 22 Mine is located in the moderately rough mountainous terrain of Letcher County in eastern Kentucky. The nearest mine workings to the shortwall area are approximately 1,900 feet distant. The depth of cover over the mined shortwall area varies from 770 feet at Panel 1 to 170 feet at Panel 5 (Figure 1). The strata in the shortwall area is summarized in the three core logs shown in Figure 2. Hole no. 2 is located in approximately the center of the mined shortwall area (Panel 3, Line C, Figure 1). The coal seam in the shortwall area is approximately 4 feet thick and horizontal, although one major ‘roll’ intersects all panels.

A new approach has been developed that is capable of ascertaining the ore component that is responsible for the preg­robbing of pregnant pulps. Many gold mines are currently treating ores containing a component that is detrimental to the recovery of gold, in that they "preg-rob" the pregnant pulp by adsorption of some of the dissolved gold. The identity of the preg-robbing component in this type of ore has been the subject of considerable debate over a lengthy period, th various suggestions including amorphous carbon, chlonte, chalcopyrite and layered silicates, such as the phyllosilicate minerals pyrophyllite, kaolinite, phlogopite and illite. A means is now available to identify and characterize the preg-robber in gold ores. This new approach consists of contacting the ore with a synthetic aurocyanide solution, identifying the mineral grains by optical microscopy and analysing each grain individually using high-sensitivity electron microprobe analysis. The approach is exemplified in this initial study by identifying the preg-robbing component in an active sample of gold-bearing shale to be an amorphous carbonaceous phase consisting of discrete particles of about 5 µm diameter interspersed with shale particles and agglomerated into grains of up to 100 µm diameter. Microanalysis of these grains as well as other mineral particles revealed that the gold content of some of the carbonaceous grains was close to 7000 g,lt, with no gold being detected in any of the other mineral phases that were found to be present (e.g. quartz, chlorite, muscovite, pyrophyllite, etc). Bulk analysis of the sample for carbon and gold confirmed that gold loadings of around 7000 g,/t would be expected if all of the gold were adsorbed onto the carbonaceous component. The carbonaceous constituent is probably also responsible for the anomalously high surface area measured for the material. It probably acts in a similar fashion to activated carbon, and the correct choice of organic blinding agent will decrease the extent of preg-robbing by lowering the activity of the material for gold, without causing any downstream problems such as fouling of the activated carbon used for gold recovery

In response to the need for enhanced precautionary measures to safeguard mine workers in collieries from the consequences of methane ignitions in a heading, the coal mining industry has ex- pressed the desire for the development and testing of active on board suppression systems. As overseas systems cannot be used directly in the bord and pillar geometry it is necessary to adapt overseas and local technology to suit local mining conditions, as well as to test such developed systems for their compliance with the expressed needs. As the systems have to be tested in a specific roadway configuration, a facility was developed to enable the testing in South Africa. A surface test facility has been established which can be used to develop and test suppression systems on continuous miners and roadheaders. This facility consists of a tunnel wherein compliance tests can be conducted in simulated underground conditions. A number of methane explosion tests have been conducted in the test facility. The explosions conducted varied in CH,/air concentration (7,5 to 9 percent) and volume (26 to 88 m3). At lower concentrations there was a marked reduction in explosion strength and flame speed. Tests carried out with the Explostop system successfully suppressed the propagation of methane ignitions in both scenarios tested.

The integrity of shale gas wells in longwall chain pillars under the influence of longwall mining is a safety concern for both coal and gas operators. Previous modeling studies of gas wells in longwall pillars have shown that a FLAC3D model can predict longwall-induced stresses and deformations in gas well casings with reasonable accuracy. The predicted casing deformations can be verified by multi-finger caliper survey. This study concerns the influence of longwall mining on eight shale gas wells in a shale gas well pad located in the chain pillars between two adjacent longwall panels under 1,030 feet of cover. FLAC3D modeling was performed to predict longwall-induced deformations in gas well casings based on site-specific mining and geological conditions. Small deformations less than 0.5 in were predicted in the intermediate casing above 600 ft depth, and very small casing deformations less than 0.15 in were predicted below 600 ft due to high abutment pressure and high frictional resistance along the weak bedding interfaces. After the first panel was mined, a 56-arm caliper survey was performed on one of the wells to measure the longwall-induced casing deformations in the intermediate casing. The predicted casing deformations were then compared with the measured deformations, which indicated that the prediction was generally in good agreement with the measurement in terms of deformation locations and magnitudes. Findings from this study provide valuable information not only for stability assessment of shale gas wells in longwall chain pillars but also for developing engineering guidelines to preserve casing integrity through adequate pillar and casing design.

The US mining industry finished the traumatic 1980s with a strong economic performance. Worldwide economic growth and capital spending led to tight metal markets. So, 1989 metals prices were generally higher than average 1988 prices. Financial markets' volatility resulted from US junk bond defaults, heavy US savings and loan losses and effects on the US budget deficit, higher energy prices, and the seemingly intractable problems of some debtor countries. Moreover, the events in Eastern Europe promise fundamental changes in the world economic system for the 1990s. US mining companies that survived the decade had weathered economic changes that, at one point, reduced industry employment by 40%, drove oil companies to divest or liquidate recently acquired mineral subsidiaries, and led to substantial write-offs of reserves. Canadian and other international minerals firms experienced similar industry upheavels. The forced modernization and capacity rationalization produced an internationally competitive US industry. For example, even though 1989 US copper production was 27% greater than in 1980, industry employment was less than half the 1980 level. The steel industry and other minerals industries showed similar productivity improvements.

Stone, one of the oldest building materials, today remains a well-established material throughout the construction industry. The use of natural stone is much less prevalent now than in the past. It is still widely considered to be the most aesthetically pleasing, prestigious, and durable building material. New and re-opened quarries are coming onstream to meet increased demand related to new building technology and increased residential use of stone. CLASSIFICATION No classification can completely eliminate overlap between dimension stone, aggregate, and decorative stone because most stone is multi-purpose. Many used for decorative purposes are not produced specifically for that end use. Rock otherwise considered waste in dimension stone or aggregate quarries can be decorative stone coproducts (Fig. 1). Many uses require a compromise between decorative and structural qualities (Bowles, 1992, written commu¬nication). Shipley (1945) used decorative stone interchangeably with or¬namental stone. Gary et al. (1972) defined decorative stone as that used for architectural decoration, such as mantels, columns, and store fronts, but added that it is sometimes set with silver or gold in jewelry as curio stones. Bates and Jackson (1987) also restricted decorative stone to that used for architectural decoration. Meanings of otherwise identical terms used in the stone industry differ be¬tween geologists, engineers, and quarriers. They often carry a much broader meaning for quarriers and engineers compared to their very specific use by geologists (Makens et al., 1972). Decorative stone, including ornamental stone, is more broadly defined by geologists as any stone used primarily for its color, texture, and general appearance. It is not used primarily for its strength or durability, such as construction stone, or in specific sizes, such as dimension stone. The decorative stone industry uses a much wider range of stone types compared to stone that is dimensioned. Decorative stone usually serves some structural pur¬pose, but is not load-bearing to any great extent. Weak or costly stones serve in decorative, not structural, applications. STATISTICS AND END USES Decorative and dimension stone data are difficult to separate because the US Bureau of Mines keeps statistics only on dimension stone and crushed stone. The value of domestic dimension stone production in 1990, which includes some decorative stone, was about $210 million compared to imports of about $524 million and exports of about $35 million. Production was 1 080 t of which at least one-third was for decorative uses (Taylor, 1992). The principal uses are rough blocks in building construction (23%) and monu¬ments (18%); the remainder is used as ashlar (18%), curbing (12%), and miscellaneous (29%). Major rock types are granite (50%), limestone (30%), sandstone (10%), slate (3%), marble (2%), and other (5%) (Harben, 1990). Crushed stone valued at $5.6 billion was produced in the United States in 1990 by 1700 companies operating 3400 active quarries in 48 states (Tepordei, 1991). About 52% is used in con¬struction, 9% in cement and lime manufacturing, 2% in agricul¬ture, 2% in industrial uses, and 35% for unspecified uses including decorative aggregate. Limestone and dolomite comprise about 71%, granite 14%, and traprock 8% of the stone crushed in the United States. The remaining 7% are, in descending quantity, sandstone, quartzite, miscellaneous rock, marble, shell, calcareous marl, volcanic cinder and scoria, and slate. The basic types of decorative stone are: rough stone, aggregate, cut or dressed stone, and manmade stone [(Table 1)]. Rough Stone Rough stone is used as it is found in nature with very limited processing such as minor hand shaping, edge fitting, and size or quality sorting (Perath, 1992, written communication). This stone type is often marketed locally in relatively small tonnages and includes fieldstone and flagstone. The primary end uses of rough stone are landscaping, edging, paving, or large individual stone landscape or interior accents [(Fig. 2)]. Fieldstone: Fieldstone is picked up or pried out of the ground (gleaned) without extensive quarrying and includes garden or large landscaping boulders (Austin et al., 1990, Hansen, 1969). Boulders and cobbles may be split or roughly trimmed for use in rubble walls and veneers, both interior and exterior. Popular fieldstone rock types include sandstone, basalt, limestone, gneiss, schist, quartzite, and granite, but many others are suitable. Much fieldstone is col¬lected by individuals or small companies because the industry is labor intensive and markets are small. The stone may be sold locally in small quantities from the back of vehicles (Austin et al., 1990). Fieldstone includes many rock types, sizes, and shapes with the only common denominator that it must be set by hand and be durable (Power, 1992, written communication). Moss Rock. Moss rock is fieldstone partially covered by algae, mosses, lichens, and fungi that give the rock an aged and variegated patina (Austin et al., 1990). The plants are supported by moisture and nutrients in the stone. Moss rock is used for landscaping, walls, and fireplaces. Although almost any durable rock can be a moss rock, most are slabby or rounded sandstone and limestone (Fig. 3). Flagstone: Flagstone or flagging consist of thin irregular slabs used for paving, walkways, and wall veneers. Random-shaped flagging is produced widely in the United States. Suitable stone

The first stage of the Massachusetts Bay Transportation Authority's Red Line Extension Northwest, is a two-track rapid transit extension from Harvard Square in Cambridge, through three stations, to the Alewife Station/Garage complex in North Cambridge. The extension, about 5.0 km. (3.1 miles) in length, is entirely in tunnel, with the Alewife Station/Garage complex and adjacent line sections of tunnel constructed by cut-and-cover methods. The Station/Garage complex, just west of Alewife Brook Parkway, is in an area underlain by deep deposits of very soft highly sensitive clays. It is proposed to construct the station and adjacent tunnel sections by the slurry trench method, using the slurry wall as the permanent structural wall of the station and tunnel. The unusual nature of the underlying clay and its very high sensitivity raised questions concerning the feasibility of the proposed construction. Since research failed to reveal any construction precedent for the specific conditions encountered, a test section was undertaken to determine construction problems, resolve uncertainties, and to establish acceptable parameters for the construction of the slurry walls. PROJECT ORGANIZATION Sverdrup & Parcel as tunnel and transit systems consultant for the Red Line Extension-Davis Square to Alewife had overall responsibility for determining program objectives, project management and test implementation.

An AFM has been applied to study in situ the adsorption of oleic acid on fluorite in aqueous solutions. The AFM images show that fluorite surface becomes smoother with the adsorption of 7 × 10-5 M oleic acid solution at pH 9. Force measurement shows that fluorite is strongly positively charged in water at pH 6, suggesting a neglectable surface carbonation of fluorite. The adsorption of oleic acid at pH 9 renders fluorite more and more negatively charged. The surface morphology change of fluorite as shown by the AFM images suggests that oleic acid chemisorbs on fluorite at pH 9. Increasing temperature can help increase the adsorption of oleic acid on fluorite. It may also improve the lateral polymerization of unsaturated oleic acid on fluorite as suggested by the smoother mineral surface in oleic acid solutions at an elevated temperature.

The ASTM standard method D 5744-96 was developed to provide a well-defined kinetic test protocol, conducted under controlled reaction conditions, with the intent of generating reproducible results. A preliminary indication of the repeatability of a simplified alternative method (MN DNR method) was assessed and results from the MN DNR method were compared to those from the ASTM method. To provide an indication of repeatability, six samples from three different rock types were subjected to dissolution testing for periods of 20 to 68 weeks. Drainage pH values at the end of the tests were within 0.5 units in all cases and within 0.05 units in four cases. The percent difference from the mean for overall sulfate rates from paired cells ranged from 0.04 to 1756, with a median of 6.3%. Nine samples from four rock types were subjected to both MN DNR and ASTM tests for periods of 20 to 132 weeks. The difference in final drainage pH values forsix of the samples was less than 0.1 unit, and these values were less than pH 3.65 or greater than pH 8.0. The final drainage pH difference for the last three samples ranged from 0.15 to 0.4, and these values were ill the pH range of 6.2 to 7.2. The sulfate release rates for the periods of record for the MN DNR method were 70 to 150% of those for the ASTM method, with a median value of 110%. Sulfate and calcium release from the two methods was not substantially different. The MN DNR method typically produced higher magnesium release.

Fifteen samples of chert from seven localities in Ohio were tested for potential durability and reactivity in concrete. The tests determined are porosity, pore-size distribution, relative degree crystallinity, specific surface area, and degree of dissolution according to the ASTM C289-71, Potential Reactivity of Aggregates, Chemical Methods. The results of these tests were compared with petrographic, electron optical, physical-chemical, and engineering properties of the chert samples. Based on these tests, the important properties that affect the durability and reactivity of chert in concrete were observed to be: (1) porosity, (2) pore-size distribution or pore spectra, (3) relative degree of crystallinity, (4) grain size, (5) specific surface area, (6) impurities, and (7) amount and species of quartz present-all of which are functions of original composition, time (geologic age), depth of burial, tectonics, and diagenesis. Preliminary results of this study indicated that the geologic history and physical-chemical properties of chert vary from one sample to another, and any one or combination of these parameters affect the performance of the chert in concrete. These complex interrelationships are difficult to ascertain; if the performance of the chert in concrete is to be predicted, it is necessary to study in detail this enigmatic material.

Two pilot scale bioreactors designed to treat acid mine drainage primarily using sulfate reducing bacteria were constructed underground at the Eagle Mine Superfund site in Minturn Colorado. The project was designed to test th applicability of microbiological treatment on water with high metals concentration and to test the process in an underground environment. Objectives were, 1) to compare metal removal, pH increase, and sulfate reduction in a single stage reactor with a double stage reactor of equal volume at varying flow rates; 2) to determine where within the substrate treatment occurs· and 3) to examine volume versus surface ara as a design parameter for optimizing metal removal processes. Results from the reactors showed that the single stage reactor and double stage reactor performed equally well for the removal of Cd, Cu, Pb, Fe, Mn, and Zn. pH increased above 6.5 in both reactors. Greater than 97% of metals were removed within the first ten inches of substrate. Volume proved to be a more useful parameter for determining removal rates than area. Using volume as a design parameter rather than surface area enables PMDT systems to be constructed as packed columns rather than broad wetlands, Thus, space requirements are significantly reduced.

NEW ROUTES - 63rd STREET CROSSTOWN The New Route construction along East 63rd Street in Manhattan began in 1969 with the East River tunnel connecting Manhattan and Queens. The 63rd Street Line, once in Queens, is planned to connect to another new route called the Queens By Pass or Super Express (See Exhibit 1) which would connect to the Queens Boulevard Line at Forest Hills. The purpose of the Queens By Pass was to alleviate subway congestion to and from the Borough of Queens, whose population had rapidly expanded during and after World War II. The existing Queens Boulevard subway lines (the "E" and the "F" trains) are almost filled to capacity at their terminal stations with passengers from Long Island. Passengers boarding trains enroute from the local Queens stations have difficulty boarding crowded trains, and, at times, cannot board the trains. The New Routes, thus, were to give additional train capacity into Manhattan and thereby relieve the crowded conditions along the Queens Boulevard corridor. PROFILE - METHOD OF CONSTRUCTION The portion of the New Route passing east-west under East 63rd Street on Manhattan (See Exhibit 2) had to snake beneath intersecting structures running north and south, such as the Con Rail tracks below Park Avenue and the 80 ft deep Lexington Avenue Express track structure along Lexington Avenue. L.R. Bower In regard to the paper by J.B. Gwiazda, it makes a highly technical approach to show that the µ factor used by designers of lemniscate-guided roof supports has never really been confirmed as a maximum and assumes that convergence is vertical. Also, the paper does not appear to take into account deflection of structures, which occurs when the lemniscate and base members are fully loaded to their maximum stress level, nor the front to back line of the support in relation to differential roof to floor movements caused by strata movements under pressure. It is not unusual for differential movements to be slightly diagonal to the line of the support, particularly in faulted areas and on gradient faces. The paper also does not take into account consolidation of fines immediately above and below the support. Generally speaking, any differential movement is from face to waste and under these conditions the µ of 0.3, which appears to be an international standard, has worked in practice. However, if the face end of the support is lower than the waste end, then the µ of 0.3 can be considerably increased, giving rise to the damage mentioned in the paper. The ideal design should aim for a slightly forward bias in the lemniscate guide so that the last increment of setting is toward the face, tending to close any fissures that may have developed during the support advance cycle. The support should also be fitted with positive set valves to ensure that a high setting load density is attained to minimize bed separation. As far as powered supports are concerned, convergence is irresistible and all powered supports converge at their rated yield load. A similar principle can be applied to the differential roof to floor movements to drastically reduce the very high forces that would otherwise be applied to the lemniscate structures and pins and that, in turn, are transferred to the base arrangement and floor loading. Any differential movements are usually catered for by the 0.3 µ factor or deflection of structures in the lemniscate guide arrangement and consolidation of the floor. The floor loading, due to differential movement, is in addition to the support convergence load and requires additional bearing area to avoid possible floor penetration. Some seven years ago, Fletcher Sutcliffe Wild Ltd. (FSW) introduced a lemniscate-guided shield support where the lemniscate linkage is connected to the roof bar through two horizontally converging rams to allow differential movement to take place above a given rated figure. This is a known force and can be guarded against, whereas with rigid connections the forces, as yet, are unconfirmed. By careful design, a horizontal force in excess of 6 MN (60 tons) opposes differential movements for a total ram loading of only 2.5 MN (25 tons), or 1.25 MN (12% tons) each. This principle can considerably reduce the length and weight of the support in comparison with a rigid pin-type structure ; also, the yield load rating can be increased without affecting the lemniscate forces. The graph shows the tensile and compressive forces in a lemniscate linkage of a support with and without hydrostore. These forces react into both the roof beam and base members and, as can be seen from the support height to linkage load graph, a considerable reduction in these reactions is gained by the use of the FSW patented hydrostore system. Floor loading is considerably reduced under maximum µ conditions, and by allowing the roof bar to move with the strata, some degree of improvement to strata control is achieved in line with the assumptions in the paper. In practice, these movements have only been in the region of a few millimeters, which, in turn, reflects on the improvements to strata control by the addition of positive set valves. Supports to this design of both 450- and 280-t (496-and 309-st) rating have been successfully used in the United Kingdom for several years, negotiating many faulted areas without one single reported need for repair or maintenance. This includes supports left unattended during the year-long strike, proving the reliability of the system.

The mining industry is an important economical factor in Vietnam. Mining is presently being conducted at about 60 locations and at over 1000 mines. Petroleum extraction and coal mining are the most important parts of industry though metals such as zinc, tin, chromites, iron are also extracted. Last year the sector produced 20 million tons of crude oil, 26 million tons of coal and 500,000 tons of apatite. In particular, Vietnam is one of the world?s largest producers of anthracite, and it is one of the top producers of ilmenite and zircon in the Asia-Pacific region. The government intends to increase the mining production on all levels, however, at present one can observe adverse impacts of the mining activities on the natural environment such as insufficient waste dump rehabilitation, occurrence of acid mine drainage, mining subsidence and emissions as well as lack of appropriate water treatment facilities. This paper describes the current mining situation, future perspectives, the major environmental challenges of the country and approaches to solve these problems. Particular emphasis will be given to the research project ?RAME ? Research Association on Mining and Environment in Vietnam?, a venture carried out by universities, research centres and industry. This project is worked out in collaboration with the national Vietnamese coal and industrial minerals company VINACOMIN.

INTRODUCTION Technologic progress depends on new and innovative ideas, the practical application of these ideas, and finally as the technology is developed and demonstrated, the engineering improvement or replacement of existing capabilities. In many areas the new ideas, although known, are not immediately put to practical use in all applicable fields. Good technologic forecasting for research and development within the excavation field coupled with adequate technology transfer is necessary to ensure timely application of innovative ideas to remove bottlenecks in the total system. The purposes of this paper are (1) to show the potential ability of technologic forecasting to meet future demands in rapid excavation through the acceleration of excavation rates by research and development in several related technologic fields, (2) to provide a brief review of the initial development of the ARPA (Advanced Research Projects Agency) Rock Mechanics and Rapid Excavation Program, (3) to draw attention to the research projects completed or underway in the FY 1970-1972 ARPA program and explain where information or program results can be obtained, (4) to summarize the progress and accomplishments of applied research contracts in the rock disintegration element of the ARPA program, and (5) to discuss the research directions planned for the remaining years of the program. The Blind Springs Hill pumice beds are located 5 miles southwest of Benton, California in the foothills between the Benton Mountain Range and Blind Springs Valley. The best exposures of the pumice are in an area 0.75 miles west of Blind Springs Hill. The pumice is Quaternary ejecta material which came from the rhyolitic volcanoes in the Glass Mountain-Volcanic Tablelands area of Mono County. The pumice beds occur in two distinct layers separated by an unconformity. The upper layer is 0 to 11 feet thick and consists of coarse subangular pumice fragments, some of which are over 1.75 inches in diameter. The lower bed is medium to coarse grained with subangular fragments up to 1.0 inch. The lower bed is 0 to 9 feet thick. Overburden at the Blind Springs Hill deposit varies from 0 to 15 feet. There are approximately 1 million cubic yards of material in the deposit that can be mined. The size distribution in the deposit is mostly fine with only 10.6% of the pumice fragments being over 0.5 inch in diameter, the minimum size needed for stone-wash or acid-wash applications. Suitability of pumice for the textile industry is quantified by standard 15-minute abrasion and absorption tests. In the Blind Springs Hill deposit, the plus 0.5 inch fraction has an abrasion loss of 33% which is too high for stone-wash application but it has an absorption capacity of 36% which makes it suitable for acid-wash applications in the textile industry. The abrasion and absorption properties of this deposit are within the range of those which have been measured for other pumice deposits within the United States.

The lacustrine Green River Formation of Eocene age in the Green River Basin, southwest Wyoming, contains the world's large resource of natural sodium carbonate in bedded trona (Na2CO3? NaHCO3? 2H2O). In this study, 126 billion tons are estimated to be present in 22 beds, ranging from 4 to 36 feet in thickness. These 22 beds underlie areas of about 50 to more than 775 square miles at depths ranging from about 650 to more than 3,000 feet below the surface. The total resource of trona ore in the basin for which drilling information is available is estimated to be about 149 billion short tons. The undeveloped deeper trona beds in the southern part of the basin may be exploitable by solution mining. Additional unevaluated sodium carbonate resources are present in disseminated shortite in strata interbedded with the trona and in shallow sodium carbonate brines in the northeast part of the basin.

MSHA is the regulatory Agency which administers the Federal Mine Safety and Health Act. Although MSHA's principles largely derive from this Act, they do not exculsively derive from it. One might expect that our principles are contained in the regulations we have published to implement the Act. To a degree, this is true; but the regulations we have now were developed and published before the current Act became effective. For this reason, as well as others, there are some principles that we support which are not evident in our regulations, or in the Act. One of these is the ALARA principle. This principle requires that all unnecessary exposure be avoided; that is, all exposures should be kept "As Low As Reasonably Achievable." Almost all professionals in radiation control can agree with this broad principle; but it would be difficult to get agreement on a regulation which would translate the principle into industry practice. Rather, our regulations specify a limit to exposure for any individual. For radon daughters the current limit is four working level months per year. By having an explicit limit such as this, the ALARA principle often becomes lost and the limit becomes the goal. The principles contained in the Act are equally broad in scope. The principles apply not only for radiation protection, but also for toxic substances and harmful physical agents. The Act states that standards for such substances or agents shall most adequately assure on the basis of the best available evidence that no miner will suffer material impairment of health or functional capacity, even if such miner has regular exposure to the hazards dealt with for the period of his working life. The Act also provides that, although protection of health must be our foremost concern, other considerations shall be the latest scientific data in the field and the feasibility of the standards. Our regulations reflected similar principles when they were developed and promulgated. From experience with other health and safety laws, Congress realized that setting and meeting an exposure limit may not be sufficient to prevent disease. The Act, therefore, contains a detailed description of additional provisions to be included, where appropriate, in mandatory safety and health standards. One of these additional provisions requires that miners be informed about the nature of the hazards associated with their job and about the means for their own protection. Another provision requires the use of labels and other forms of warning to inform miners about the hazards, about proper precautions for safe use or exposure, about relevant symptoms of overexposure, and about emergency treatment. We have partially implemented these provisions through regulation. The Act requires also that standards shall prescribe protective equipment and control of technological procedures and that they shall provide for the monitoring of miners' exposures. We have implemented this provision to a degree also through regulation. Finally, the Act specifies that, where appropriate, a mandatory standard must prescribe the type and frequency of medical examinations in order to most effectively determine whether the health of miners is adversely affected by exposure. Additionally, when a determination is made that a miner may suffer material impairment of health or functional capacity by reason of exposure, that miner must be removed from such exposure and reassigned. In order to encourage miners to take the medical examination, the Act also provides that the miner shall not suffer loss of pay as a result of being reassigned. This additional provision on medical examinations has not been implemented by regulation for radiation hazards, nor for most other toxic substances or hazardous physical agents. We believe that this conference will provide us with valuable information on medical examinations for radiation exposure, as well as on other considerations to be used in future regulations. We still question whether our basic exposure standard of four working level months per year is adequate to protect a miner's health. This conference is indeed timely because both MSHA and NIOSH have been reviewing this issue for some time. I would like to reemphasize MSHA's commitment to education and training. MSHA strongly believes that miners should be informed fully about the real and potential hazards associated with their work. They should know the nature of the hazard and the means for protecting themselves from the hazard. The Act also emphasizes the need for training miners by requiring that new miners receive 40 hours of training before working underground and 24 hours of training before working on the surface. The Act also requires eight hours of refresher training annually. This training must include information on the relevant health hazards and the potential consequences of overexposure. Before I close, I would like to mention briefly another source of principles that MSHA often consults to obtain guidance for both the development and enforcement of regulations. These are the various court decisions that are handed down from time to time. Two in particular that I want to stress are the recent Supreme Court Decisions on benzene and cotton dust. Although neither of the decisions has a direct impact on mining or radiation, they do clarify some general principles and directions for regulatory agencies, such as the role of cost-benefit analysis and the need for risk assessment. In closing, I wish us all an open exchange of information for a productive and useful conference.
