PRESIDENT LITTLEJOHN: Before we open the discussion on the Utah mining laws, I want to bring out what I consider a slight misunderstanding on some of the things that I said this forenoon relative to our comparison of accidents. I did not mean to infer that we, as mine officials, are satisfied we have done the best we can to eliminate the accidents, when I was talking about a four-to- one comparison. I do not want any- one to get the idea in their heads that I do not think we are doing all we can. There is not any of us who can state that, even if we better these figures. It is the general understanding that these figures are based upon ratios per thousand man shifts and not upon the tonnage basis that we use. If it were based upon a tonnage basis, I think the figures would be pretty nearly reversed, for we are producing from two to four tons more per man than they do in Great Britain. The discussion will now be continued as I said this morning. There is a gentleman in the audience here that is as guilty of making these laws as I was, and I am quite sure when speaking he will confine himself to the subject of Utah Mining Laws and the prospective results. Before Mr. Monay starts with his paper, I want it understood that this discussion must be finished by 2:30 for the reason that we have still quite a lot of business before us this afternoon.

A facetious title was purposely given this talk, so that a formal paper would not be expected. TWO or three days ago, while discussing with Mr. Dickinson some of the details of the dust explosion demonstrations we are planning for this coming Saturday, I remarked that we would like to have as many people as possible see some samples of 20 and 200 mesh dust, so they would more fully understand just what was causing the explosions. Mr. Dickinson requested that I bring samples and screens and in this informal manner, give you all a ".close-up" of coal dust which is considered in Explosion Hazard reports. While sampling mines, for road, rib, and roof dust, in connection with safety service and hazard reports which the Bureau of Mines Engineers make at the request of coal operators, I have often been assisted by under- ground mine officials or other men of many years experience and on almost every occasion, while we were carefully brushing the very fine dust from timbers or coal surfaces, they would make some remark such as: "never had noticed this kind of dust, didn't know it was here", or "well, that's the first time I really understood what all 'this dust talk was about." Such experience makes me believe that the much published terms, 20 mesh and 200 mesh are just numbers to the great majority of both miners and operators. We are now going to have lesson one in the primer of coal dust explosions and I want to say, in all sincerity that a complete course in the hazards of mining is deserving of a place in the curriculum of the best mining schools of this country. Sample No. 1 is fine coal and dust and is a fair sample of what can be found every where in rooms and entries of a mine, as it is too small to be gathered up with a shovel and is left in the ordinary mining at the faces and is spilled along the entries in haulage. In this you will see some quarter inch coal, much eighth and sixteenth inch coal, in fact those are the sizes I find many people have in mind when they are asked about the dust made in mining. Although the sizes mentioned are the ones which seem to almost entirely make up this sample, such is not the case, for from 10 to 20% of such a sample will usually pass this 20 mesh screen and in Sample No. 2 we have 20 mesh dust. Result of many tests, supports .the statement of the coal mining division of the Bureau, that it is quite probable that coal over 20 mesh does not take part in any but the most violent of explosions and that all dust under 20 mesh may take part in any explosion. The largest particles in this sample will not be over .03 inches in their largest dimension and a pound of dust to a foot of average heading is very easily found in most every mine I have visited and usually a great deal more can be readily gathered up. It was .found early that the finer the dust the more dangerous it was for a given coal. So for the early explosion tests conducted by the Bureau a commercial pulverizer was used and it turned out a 20 mesh dust of which about 75% would pass 200 mesh. Some men question whether the ordinary mining methods made such a dust and so doubted the explosibility of the dust in their own mines. The question was well taken, and hundreds of dust samples were taken by the field men of the Bureau to determine the kind of dust being made in all methods of mining and all classes of coal. The result of such sampling showed some coals. resisted breakage more than others and that actual mine road dust, through 20 mesh, would show from 10 to 20% through 200 mesh, and for actual rib and roof dust through 20 mesh, they would get from 20 to 40% of 200 mesh dust. I read a book the other day called Opportunity 2000. The book, Opportunity 2000, talks about what's going to happen in the next nine or ten years as we propel ourselves through the 1990s into the 219 century. The book, Opportunity 2000, is a futuristic book, somewhat like Megatrends. It said that by the year 2000, baby boomers will be old people, and when you got here before the baby boomers, how does that make you feel? It said that there will be more women in the American work place by the year 2000 than men. The book, Opportunity 2000, discusses diversity. The big challenge for the 1990s is ?diversity?. We'll have the D-word in the 1990s. We had the G-word in the 1980s ? ?global.? Diversity in terms of more immigrants, more minorities, more females into the American work place, but also value systems diversity. We'll have to deal and adapt to four different generational clusters in dealing and interacting with employees and management in the 1990s-value systems diversity. I think there will be five generational clusters that we'll have to deal with. Massey says four. He says we'll still have the old people around, the World War II mentality; those who

PRESIDENT LITTLEJOHN: I have every reason to know Mr. Pryde was carrying out some experiment a while ago in some of his mines. He and I had a little correspondence on the question, and I think he may have a word or two to say about it. He has not been on his feet today at all. I will ask Mr. Pryde to tell us what he has to say. MR. PRYDE: I have not very much to say about shooting coal with permissible powder as far as slack is concerned because we are not in the commercial business. All of our coal goes to the railroad and a very large part of it is crushed for use in the stokers of the locomotives. We are on a 100 per cent permissible powder basis and as far as I am able to see, I do not believe that the percentage of slack is increasing with its use. We find it hard to convince our commercial neighbors of this fact because they are naturally very much against increasing their percentage of slack on ac- count of the low price received for this grade of coal. I, personally, believe that where a change is made from black powder to permissible powder the percentage of slack will be increased for a time because the miners have been accustomed to using black powder and they are rather suspicious about going to the permissible powder and I do not believe that we can blame them very much. So the tendency with them is to use too much powder. We have gradually overcome this, although, as I said before, we have not kept close track of the production of slack. However, we try to get as large an amount of lump coal as possible. Broadly speaking, I can say from observation that in my opinion there is very little difference in the percentage of slack with the use of the permissible powder that we have today than there was with the use of black powder. I also get this information from our mine superintendents. Mr. Peterson and the other explosive men have been very helpful to us in the use of permissible powder and I confess I have to take everything back that I said several years ago. At that time I was against permissible powder, particularly on account of the cost, but, with the newer permissible powder, we have gotten the cost down very well. I know today that the cost of permissible powder in the coal mines of the Union Pacific Coal Company is less than when we were using black powder. I know this because of the fact that we kept a record of the number of tons we got with black powder, and the number of tons we get with permissible powder compares very favorably in cost. I know this, too, because of the fact that our employes, except in the first few weeks of using permissible powder, have made no demand upon us for any in- crease ill pay to offset any added cost that might accrue in the use of permissible powder and the fact that they have asked for no increase is very conclusive proof to me that it is not

The eightieth regular meeting and convention was called to order by the President, John T. Atkins, at 9:15 a.m. Monday, June 25, 1984 in the Colorado Ballroom of the Marriott's Mark Resort in Vail, Colorado. President Atkins welcomed the members and their guests to the convention and noted that the annual business meeting would be held Tuesday afternoon at 2:00 p.m. in the same room. A convention update was made by the Conven¬tion Liaison Officer, Loren V. Linville. This was followed with a program report by the Program Chairman, Doug Ingram. The chair then called on Clifford Barrett, Upper Colorado Regional Director of the Bureau of Rec¬lamation of the United States Department of the Interior. He presented the Bureau's Citizen Award to RMCMI former president Ira E. McKeever for his outstanding contributions to the joint private/ Federal effort and the open planning process for AQUATRAIN. According to Barrett, "from 1981 to early 1984, McKeever led private industry work in the AQUATRAIN project, a proposal for a 1,400 mile long pipeline system. AQUATRAIN was conceived as a possible alternative to solve the government's problem of rising salinity levels in the Colorado river, as well as the private sector's need for a more economical coal transport method. The Citizen Award cites McKeever's efforts in developing a model for future cooperative ventures between government and industry that can benefit the nation." Following this presentation, the formal program of the 80th meeting and convention began with the president, John Atkins, introducing the convention kickoff speaker, Andrew Franklin, President of Nerco Mining Co., Inc., followed by the convention keynote speaker, Dr. Margaret N. Maxey of the University of Texas. These speeches are printed in this Proceedings together with those of all other convention speakers. I'm Andrew Franklin, President of Nerco Min¬ing Company, and I'm delighted to be here to kick off the annual convention of the Rocky Mountain Coal Mining Institute. This has always been a very special convention in my eyes and I'm sure this year's will be no exception. I am also here to share my thoughts on the western coal industry and how we're all affected - for good and bad - by public policy decisions. Although the title of my talk is "Western Coal: An Industry Under Siege," I believe a more accurate title might be "Western Coal: The Pit and The Pendulum," because of the wide swings in public policy and coal development in the past 15 years which have cut a zigzag path for growth over this period. As one of the nation's largest coal producers, Nerco is well aware of the problems facing western coal production. Nerco Mining Company is the western coal mining subsidiary of Nerco Inc. We have been "in coal" for more than 25 years through our parent company, Pacific Power & Light. To state my conclusion at the outset, I feel it's extremely important that consistency and common sense should guide our national policy for the development of valuable energy resources. In particu¬lar, we must reduce the wide swings in government policy and activities which have affected energy development. In short, we must decide what kind of game we're playing so that the "players" and the "referees" can keep their eyes on the "ball." Business today faces two main types of uncertainty market uncertainty and public policy uncertainty. As businessmen, we expect and are used to facing the familiar challenges and uncertainties of the market in which we operate. Over the past 10 years, the market has appeared to be bullish on coal. The 65th Regular Meeting of the Rocky Mountain Coal Mining Institute convened at the Stanley Hotel, Estes Park, Colorado, and was in session at 10:00 a.m. The first session was called to order by Past President Joe T. Taylor, Kaiser Steel Corporation, Palo Alto, California. Manager of the Stanley Hotel, who welcomed the guests to the Stanley. After a few remarks, he introduced Bob Dean, for- mer Manager of the Stanley Hotel and again associated with the Stanley, who also made a welcoming talk as Mr. Dean has hosted the Institute at the Colorado Hotel in Glenwood Springs and in Estes Park. Mr. Taylor introduced President Stanley C. Shubart, Secretary-Treasurer, Schloss & Shubart, Inc., Denver, Colorado. Stan was raised in the machinery end of the coal industry following the footsteps of his Dad who was one of the founders of the RMCMI in 1912. And following his Dad's years of service to the Institute, 12 of them as Secretary, Stan has been active as Chairman of the Hotel & Registration Committee for 16 years, and, prior to his election as President, was General Chair- man for two years He is a graduate of the University of Colorado with a degree in mechanical engineering. He served our country in World War II and retired as a Colonel, Army Ordnance, after 43 years in the Reserve. He is a Trustee of National Jewish Hospital and was their President for 3 years. He has been active in many Military and professional societies, and in civic projects. I give you our President, Stan Shubart, for his remarks.

At 5:30 p.m. a social hour was held for all RMCMI registrants on the lawn area south of the Gondola Lift House. This was followed by a western steak fry and dancing to the country western band, "The Cat's Night Out". MORNING SESSION Tuesday, June 29,1982 RMCMI golfers came out in force for a shot-gun start of the Championship Golf Tournament at Vail Municipal Golf Course which began its first session at 7:30 a.m. followed by a second at 1:15 p.m. The tournament was headed by William Carpender, chairman and his committee members Gary Bennewitz, Jr. and Gene Christmann. RMCMI members were treated to early morning rolls and coffee in the Conference Center preceding a showing of the RMCMI slide/tape program on enhancing the image of coal mining, by telling the story of the Institute. Following this, the meeting was called to order by President McKeever at 8:30 a.m. when he introduced Mr. Carl Terzian who presented a workshop entitled "Sure You Have an Image - But What Kind?". MR. McKEEVER: Good morning Carl. I see you're ready to address this bright and busy tail audience. One of the things that I really want to point out this morning and I knew we would have a second chance with Carl Terzian but Carl is someone that will leave a good lasting impression on you and what he will hopefully be talking about, as I remember, is that what he's saying here can be used personally, or for company, or for the Institute, or anything else on image. Carl is Chairman of the Board of Carl Terzian Associates. He is a prominent author, lecturer and consultant. He is headquartered in Los Angeles and he's nationally known: governmental affairs, man¬agerial development and executive speech training and has served nearly four hundred clients since 1969. Each year he travels nearly 300,000 miles to address conventions, conferences and sales and management meetings as a motivational speaker. Carl has been speaking professionally for more than twenty-five years. He was graduate magna cum laude 1957 from the University of Southern California where he was elected Phi Beta Kappa and student body president. He later served as State Department goodwill ambassador for President Eisenhower; public relations director for Lutheran Hospital Society of Southern California; dean and professor of political science and speech at Woodbury University and public affairs director for architect Charles Luckman. He has been honored for his civic and philanthropic and professional accomplishments by the Congress and State Department, California Assembly and Senate, City and County of Los Angeles, Her Majesty the Queen of England, and six times by the Freedom Foundation of Valley Forge. Carl, welcome to our Coal Mining Institute and it's been kind of a historical situation on Tuesday morning that we will probably have people straggling in after that wonderful steak fry that we had last night. Mr. President, Officers and Members of the Rocky Mountain Coal Mining Institute: This is my first attempt to prepare and read a paper before your association. The Rocky Mountain Coal Mining Institute, I understand, was formed for the purpose of increasing knowledge relating to coal mining in all its various branches by study, research and discussion. In writing my paper, I have tried to be as practical as I can, at the same time, present my arguments so that they can be easily understood. When I use the word science, I mean organized common sense. I humbly ask my hearers to be a little patient, while I read my paper, and be "to its faults a little blind, and to its virtues a trifle kind". Western Europe is said to be the cradle of the coal mining industry. We are told that the Ancient Britons were acquainted with the use of coal long before the Romans invaded and conquered their country. The Romans were never too proud to learn from the outer barbarians, and possibly acquired the precious secret from them: We are told that it was not until the 13th century, that the coal mining industry, assumed any noticeable importance in Britain, and on the Continent. In the year 1259 Henry the 3rd granted a charter to the freemen of New Castle on Tyne, allowing them to mine coal. For a long time it was used in the arts and manufactures only, wood continuing to be the common domestic fuel. As has been the case with almost every great benefit, the introduction of coal as a fuel was stoutly resisted at first, and we find its use prohibited in the city of London in the reign of Edward II, by Royal proclamation ; which was soon discovered to be injurious and foolish, and consequently withdrawn. It is interesting perhaps, to know how this Royal proclamation was brought about. A lady of the Royal household was riding in her coach one day through a village in which coal was burned as a fuel, and she suffered such a cough by inhaling the coal smoke that she decided to call a council of suffragetts, who ultimately decided that the burning of coal was injurious to their health and complexion. They drafted out a petition and presented it to the king, who speedily issued the order that no coal was to be burned in the city of London. The penalty for disobeying this order was death by hanging. We are informed of one poor man who continued to burn a lump of' coal on his fire in winter time; he was arrested, sent to prison and condemned to death; the judge in passing the sentence solemnly stating that if he was not allowed to get a fire that was hot enough in this world, he felt that he surely would be allowed one in the next.

Benedict Shubart, Secy, Rocky Mountain Coal Mining Institute. Denver, Colo. Dear Sir: "Sorry not to be able to be with you but since my function in the Institute has been largely along the line of `stirrer up of trouble' (of course always with the aid of Dalrymple), I do not wish to fall from grace now so am sending you a pamphlet on the last page of which is a' tabulation as to accident indices of various coal mining states and it seems to indicate that the states comprising the Rocky Mountain Institute have the poorest accident record of all the states producing coal. "It seems to me that even allowing for possible deficiencies in connection with placing accidents upon basis of hours of exposure, our western states need to `tighten up' as to safety practices, hence I hope that the Safety Committee report will be both drastic and progressive and that western coal mines apply the drastic proposals in addition to approving them as the policy of the Institute. Why wouldn't it be advisable to have a committee appointed to ascertain why the safety record of the states comprising the Institute is so bad as to coal mines? Wishing the Institute all kinds of success." (Signed) D. HARRINGTON. SECRETARY SHUBART: He encloses this pamphlet issued by the Bureau of Mines. On the back of it is this table; and it is a fact that the Rocky Mountain States are down at the lowest in almost every case, at the lowest point, with the highest accident rate in almost every kind of accident. Maybe he is wrong; maybe he states this for reasons. That is a rotten looking table for us.

President W. K. Dennison, Jr., called the final session of the Rocky Mountain Coal Mining Institute to order, and introduced H. A. Cornell, Portland Cement Association, Ft. Collins, Colorado. Mr. Cornell explained that the Portland Cement Association was not a sales organization, but is supported by the major manufacturers of portland cement. The research laboratories of the association are constantly endeavoring to improve the quality of cement, as well as promote new markets, new uses, and new ideas. The association works with engineers, contractors and universities, making available to them the results of their research. Mr. Cornell stated that numerous booklets and bulletins were available on request for any phase of construction with concrete. Mr. Cornell presented a film, "How to Make Quality Concrete," to the members of the Institute. D. W. Lyke, General Electric Apparatus Service Shop, Denver, Colorado, was introduced by President Dennison, who presented a film, "A-Hunting He Would Go." Following the film, Mr. Lyke stated that his firm was not confined to electrical equipment, but to all types of equipment, and asked the members to feel free to call for assistance at any time. These two films concluded the Manufacturer's Hour, and President Dennison opened the final business meeting of the session. Robert F. Bowie, of the Auditing Committee, read the Treasurer's Report, and complimented Mr. Whiteside on the commendable state in which the books were found. The Treasurer's Report is as follows:

Gentlemen: I'm glad to see the crowd that's here this morning, glad to renew acquaintances with many old friends, and if you'll look at the program you'll see a heading there which states that as President I have the honor and pleasure to be here to address the membership of this meeting of the Rocky Mountain Coal Mining Institute, this being the 49th regular meeting. The tentative schedule of this gathering lists on the program the "President's Address," and I want to assure you that this will not be an address or a lengthy speech. It's said that a good speaker is one who arises to the occasion and then promptly sits clown, so please be at ease for I intend to sit clown very soon. There are other men here who have spent time writing and preparing papers on subjects that are to come up for discussion at this meeting, which will be, I'm sure, more interesting than what I have to say this morning; so again I'll say, we'll get this part of the program under way promptly.

CHAIRMAN I. N. BAYLESS: Will you come to order, gentlemen? They told me that you had a very interesting meeting yesterday and a good time last night. Our program is rather long this morning, and I am not going to take up any of your time, as we got started a little late. I will ask Mr. Marchant to make a few announcements. (Announcements.) SECRETARY MARCHANT: I just noticed in this morning's paper a rather serious accident at Hobbs, New Mexico, in which George Kaseman, a former President of the Institute, and a loyal member ever since its organization, was killed. I think that this meeting should go on record and prepare a resolution of condolence, etc., and with your per- mission we will have the Committee on Resolutions do that. I assume that will be all right. CHAIRMAN BAYLESS: Our first paper and discussion this morning will be Education of the Miner, by Thomas Allen, Chief Coal Mine Inspector of Colorado. Mr. Allen.
