Underground construction involves all the legal problems common to the construction industry and adds a nice little group of its own. Elements which will ultimately affect contractor-owner relationship commence to form almost as soon as the owner conceives of the project. A few of these with emphasis on their application to underground construction will be mentioned. (1) During the design stage, determination must be made as to whether the specifications will be general or restrictive. To what extent will the operations of the contractor be controlled? Can he proceed to use any method of tunnel excavation that he desires and only be responsible for the end result or will specific excavation procedures be required? Can explosives be used? Under what restrictions? Are tunnel supports required? How long can the crown behind the heading remain unsupported? What kind of supports are required? What restrictions on the placement of tunnel-lining concrete will be required? Each of you could extend this list for many pages but these illustrations are indicative of decisions that must be made in advance of bidding, and the ultimate decision on each question can have a significant effect on the legal relationships that exist between the contractor and the owner. The owner wants a good job at a fair price. On the other hand, nothing is worse than having a tunnel collapse during the construction period, with its extra costs, loss of life, and delay to the entire project. If the specifications are too restrictive, increased costs of performance are bound to occur. Owners save tremendous amounts of money by obtaining a contractor who has been ingenious in devising the most economical construction procedure. Care must be taken in drafting the specifications so that the benefits of such ingenuity will not be lost. (2) HOW is the contract to be awarded? Will there be open bidding, a restricted list of bidders, or will there be negotiations with a comparatively few contractors? If it is a government project, whether Federal, state, or

THE importance of ladle and teeming practice and its relationship to the yield and quality of the product has focused considerable attention on this phase of open-hearth operation. Inherently bad steel cannot be perfected by manipulation during teeming, but through the proper handling of "off heats" serious losses, which in many cases arise, can be greatly minimized. Conversely, good steel can be ruined as a result of poor workmanship in the pit, and rendered unsuitable for application to orders where exacting surface and physical requirements are essential. Sufficient evidence has been secured to warrant careful investigation of pit operations when an abnormal number of basic defects develop in the semifinished product or are found on the inspection table. This paper is written from the standpoint of the problems involved in making satisfactory ingots for sheet rolling. Furthermore, since rimming steel is almost universally used for manufacture of sheet, the data presented herein refer particularly to that type of steel. Going back some 30 years in open-hearth history, the word "pit" properly described the hole into which the ladle was lowered to receive the metal tapped from the furnace. The working space was necessarily limited, and the disposal of slag and metal overflowing the ladle or lost because of breakouts presented a serious problem. The equipment, of course, was rather crude in the light of present-day development. Often no ladle stands were provided, the ladle being hung on the crane beneath the runner. When delayed taps occurred, the ladle was often held in position for many hours, thus tying tip pit operations and causing delays to adjacent furnaces. Because of crowded conditions, slag thimbles were not used and a network of cast-steel triangles and old tapping bars, placed before the heat was tapped, was the means for removing slag from the hole. Steam is, and doubtless always will be, the basic power in the anthracite industry, either directly applied through engines and pumps or electrically. The rapidity with which electric power is being applied to the mining and preparation of anthracite leaves little doubt as to its utility and economy. There is practically no operation, except possibly the drilling of hard rock, that has not been successfully electrified and the matter of drilling is handled economically with electrically driven compressors and the standard compressed-air drills. Conservation and the seemingly ever-increasing cost of production, justify careful consideration of the possible results of the more extensive use of electric power in the industry. It is not planned to discuss, herein, the relative economies of individual applications but to consider the relative economy and flexibility of steam and electric power. The reports available for the year 1920 indicate a production of slightly over 80,000,000 tons of anthracite, of which 8,843,500 tons were used for power and heating purposes; in other words, over 11 per cent. of the production was used at the mines. Some of this was used to generate electric power at the mines, about 160,000,000 kw-hr., while 150,000,000 kw.-hr. was purchased from the public utility companies. One large producer, who is buying some electric power and generating some, used over 13 per cent. of the production for power and heating at the mines. Another producer, where considerable electric power is generated on the properties, is using less than 9 per cent. of the output for power and heating. One of the largest producers has a fuel consumption of over 15 per cent. of the output, besides which considerable power is purchased. A careful study of the field indicates that steam-operated plants use upwards of 13 per cent. of the production for power and heating, while electrically operated plants use about 1 per cent. for heating; so that, for steam-power purposes at least 12 per cent., or 268.8 Ib., are used for power out of each ton produced. In the complete electrification of anthracite mining operations, no set rule can be given for the power requirement, in kilowatt-hours per ton, as conditions vary widely in the matter of pumping, ventilation, and transportation, but the following cases are given as a basis of determining a range and a possible average power requirements:

There has been no noteworthy increase in production during 1935; but, on the other hand, there have been ample manifestations of a considerable increase in interest and activity in connection with petroleum prospecting. The Lakes Entrance field, in the State of Victoria, on the coast some 120 miles east of Melbourne, remains the only actual producer; and this production, consisting of lubricating stock devoid of light fractions, is very small in amount. Arrangements have been completed under which a series of "scout bores" for structure testing in the region of Lakes Entrance will be sunk by the Government of the State of Victoria, assisted by a subsidy from the Federal Government. Prospecting In the State of New South Wales, brilliant geological research in very difficult country, carried out by geologists of Oil Search Ltd., has revealed several previously unsuspected domal structures in the Sydney-Newcastle coal basin. These have been mapped in detail, and a test well is being sunk at Kulnura, 10 miles west of Wyong and 40 miles north of Sydney. At the date of writing this well has reached a depth of 1250 ft., 10-in. casing having been set at 1248 feet. Superficial formations consist of the Hawkesbury sandstone and Narrabeen beds of the Hawkes-bury system (fresh-water Triassic). It is anticipated that the upper coal measures of the Kamilaroi (Permo-Carboniferous) will be entered almost immediately. The objectives of the drilling are the upper and lower marine beds of the Kamilaroi system, which are regarded as promising as potential source—and reservoir—beds for oil. At Mulgoa, 30 miles west of Sydney, a bore is being sunk by the same company, Oil Search Ltd., to test for natural gas on a well defined structure located by the company's geologists. Noteworthy flows of gas have been encountered, but nothing approaching a commercial supply has been struck. It is considered probable that the gas has been derived

Anticipating the increasing importance of establishing working conditions on a scientific basis, the Department of Labor created the Working Conditions Service. This service is distinct from that performed by the Mediation and Conciliation branch, which deals with working conditions and industrial relations as controversial issues between employers and employees. The work of the Service is conducted through three coordinated divisions; Division of Industrial Hygiene and Medicine, Division of Labor Administration, and Division of Safety Engineering. The Division of Industrial Hygiene and Medicine will develop standards of sanitation and medical practice in industries. The personnel of this Division is detailed from the United States Public Health Service. The Division of Labor Administration will advise employers as to employment systems and labor management policies, and assist in putting into operation standard policies.

THE liability for damages to the surface caused by subsidence is an ever present threat in all underground mining. In ordinary lode mining, this threat rarely materializes into an action, due to the method of mining metaliferous ores, the dip of the veins, and the nature of the ground itself. In the mining of coal, however, this threat is very real. The coal frequently lies close to the surface, in beds underlying large areas of land the surface of which is suitable for agricultural or urban development. Furthermore, the coal is generally mined by the "room and pillar " method and when the pillars of coal are removed, the subjacent support is destroyed. This question of the duty of surface support has now become a very live one in Colorado. What was waste prairie land a few years .ago, has become valuable agricultural land dotted here and there with growing towns. Frequent references will be made here to Colorado conditions and adjudicated cases, but those conditions and cases and the conclusions to be drawn therefrom are equally applicable to all coal-mining states. Briefly stated, the question is "Does the owner of the substrata or underlying mineral, owe any duty of surface support to the owner of the superjacent strata or surface?" There is no absolute duty of support owed by the mineral owner and this assertion is made with full knowledge of numerous expressions to the contrary by courts of Pennsylvania, Illinois, Colorado and other coal-mining states. Whether or not any duty exists depends upon the circumstances surrounding each case, and since in the nature of things those circumstances are rarely identical, there can be no absolute rule.

The authors are to be congratulated for their excellent effort in quantifying a difficult problem with realistic cost data. Economic analysis of the components of a mine ventilation system is complicated by both the dynamic nature of the system and the uncertainty as to the time when system changes occur. We wish to address three specific areas of this paper which require further consideration: shaft designed air capacity, shaft location, and economic criteria used within the analysis

Nowadays, the beginnings of such a path are discernible in Tennessee, as folks of the metallurgical persuasion find it to their pleasure and profit to call upon the Sage of Copperhill. They come, more and more respectfully as the years go by, yet to ever fewer persons is he known as Mr. Myers, but to more, eloquently, as Jack. Find better ways to run your mill, find happier means of co-ordinating your humanities or serving your professional society, and it's just like the man said about the mousetrap. A druggist's son, born in Wisconsin, May 24, 1889, reared on the Bible in Ohio and Indiana, and completing his education in Colorado, this now indisputably 24-carat Tennesseean has had a checkered career. Going West as a laborer at the tail end of the 1907 panic, he did not make his fortune but he did gain an understanding of labor that in later years endeared him to his men. Graduating in 1913 from Colorado School of Mines with the degree of E. Met. and a string of football letters (also earned the hard way, at tackle) he went to work in Butte & Superior, just at the beginning of the Golden Age of flotation.

Mining practice and underground studies show that, besides mining stresses, lateral tectonic stress also influences roadway stability. Roadways perpendicular to the direction of major lateral stress experience the majority of roof falls, accelerated floor heave, and extrusion of coal ribs into openings. They have the most severe deformations and their maintenance is difficult. Roadways parallel to the major lateral stress exhibit roof sagging and bed separation, moderate though sometimes uneven floor heave, and slabbing of coal ribs into openings. Roadways oblique to lateral stress have, to a certain degree, self-supporting roofs, uniform floor heave, and limited sloughing of coal ribs into openings. The optimal orientation of roadways is, therefore, oblique to the lateral stress direction with fewer crosscuts between them.

In 1934 the Southern Experiment Station of the U.S. Bureau of Mines in. cooperation with the University of Alabama began an investiga-tion of the availability of kyanite ores as a source of raw material for the manufacture of refractories. Under this program, gravity concentration and flotation tests have been made on two varieties of Georgia kyanite ore, mica schist and massive. Most of the attention has been directed to the mica schist ores, as they are more widely distributed and seem to offer greater economic possibilities than the massive ores. It is evident that the preparation of kyanite for use as a refractory material involves other considerations than the mere elimination of impurities. A concentration process that eliminates impurities satisfactorily may have to be followed by some additional treatment, since the final product must be of a coarse-ness and size ratio that will make it suitable for refractories manufacture. So far in the investigation at the Southern Experiment Station of the U.S. Bureau of Mines only the concentration problem has been considered, and this paper is intended as an interim report.
