One of the heaviest burdens uselessly cast by our mineral land laws upon the holder of the title conveyed by a patent from the United States is due to the provision excepting known veins from land patented as placer. In many instances the expense of defending such titles from the assaults of the owners of lode locations made upon the theory that the veins so located were known to exist at the date of the placer application for patent has exceeded many times the value of the land in question. Neither the lapse of time, however long after the issuance of the patent. nor repeated adjudications by the courts serve to quiet such titles Or to prevent them from being questioned. In the passage of laws providing for the acquisition of title to the mineral lands of the United States, Congress provided that the title to known veins should not pass from the United States by a patent based upon a placer location. As construed by the courts, the law (Sec. 2333 R.S.U.S.) provides that the applicant for a patent upon a placer claim may, if any vein of sufficient value to justify the expenditure of money in its development is known by him to exist within the boundaries thereof, include in his patent application an application for patent upon the vein as a lode claim; and failure to do so is to be deemed a conclusive declaration that the applicant makes no claim to the vein nor to an area of surface ground extending for 25 ft. (7.6 m.) on each side of its middle or center. As to such vein and such area of enclosing surface ground under the circumstances stated, the title remains in the United States notwithstanding the issuance of a patent that purports to convey the entire surface of a described area and everything beneath it, excepting only the segments of veins the apices of which lie outside of such area. Such known veins with such area of enclosing surface ground are, of course, at any time, so long as they remain unlocated, subject to location and appropriation in the same manner as other. veins upon the public domain. The history of the operation of this law in one district will serve to illustrate its effect generally throughout the mining regions of the United States. Forty years ago the atom was split and the Age of Fission dawned. Uranium was the element used in this earth-shaking accomplishment. Thitherto almost unknown to the man in the street, uranium soon became widely and persistently sought. And the quest for this unique material is not likely to diminish during this century. To find is one thing; to own is another. Who owns uranium in the ground? Where no mineral rights in the land have been severed by devise, grant, reservation or lease, the uranium belongs to the fee simple owner of the land. But where there has been a conveyance or reservation of all or part of the "minerals", determining WHAT a substance is has been the traditional way of determining WHO owns it. What, then, is this element called uranium? The 1907 edition of Watts Dictionary of Chemistry calls it "a lustrous, hard, silver-white metal". Of nature's three prime divisions it falls within the embrace of the mineral kingdom - substances neither animal nor vegetable. In its natural state uranium always is combined with other elements or substances in the form of an ore mineral. May we, then, put to rest any doubt or question as to the nature of uranium and classify it for all purposes, including that of ownership, as mineral? Not quite! That self-same logic would find oil and gas primly ensconced in the animal or vegetable kingdom. Technically, oil and gas are not minerals but legally they have been classified as such. Why? The Supreme Court of Tennessee sought the answer in 1897 in the case of Murray v. Allard, 43 S.W. 355. After citing authorities pro and con, and while admitting their origin to be "decomposition of marine or vegetable organises" that court firmly concluded that since they were obtained by a form of mining, oil and gas were minerals. From the above example two elementary truths emerge. First, for purposes of ownership, uranium is and will be whatever the courts say it is. Secondly, the courts historically and currently favor a practical rather than technical test to determine the "mineral" character of a substance. So now we turn to the jurisprudence for enlightenment and definition. EARLY CASES ALLOT URANIUM TO MINERAL OWNERS Two early cases involving the ownership of uranium followed what had been well-settled mineral within the meaning of the conveyances involved, confirming ownership in the mineral owners. In 1956 the U. S. District Court for New Mexico in the case of New Mexico and Arizona Land Company v. Elkins, 137 F. Supp. 767, appeal dism'd 239 F.2d 645 (10th Cir. 1956), found that a 1946 deed reservation of "all oil, gas and minerals underlying or appurtenant to said lands" included uranium and thorium. The court reasoned that uranium and thorium, being minerals within the scientific, geological and practical meaning of the term, would certainly constitute minerals within the purview of the reservation. While agreeing that uranium and thorium were "minerals", defendants argued that at the tine of execution of the conveyance it could not have been the intention of the parties to reserve them because they had no commercial value in the locality and were, in fact, not known to there exist until their later discovery in 1950. The court re¬jected, as a matter of law, this "lack of knowledge" theory citing the Supreme Court of Kentucky holding in Maynard v. McHenry, 113 S.W. 2d 13, that: "The mere fact that a particular mineral has not been discovered in the vicinity of the land conveyed or is unknown at the time the deed is executed rules of construction and held that uranium was a does not alter the rule . . ." that a grant or exception of "mineral" in a deed includes all mineral substances which can be taken from the land unless restrictive language is used indicating that the parties contemplated something less general than all substances legally cognizable as minerals. Further, argued the defendants, the only feasible mining procedure for such substances was open pit or strip mining, which would destroy the value of the land for grazing or agriculture. Finding that the language of the reservation was clear and unambiguous, the court would not permit the admission of extrinsic evidence as to mining procedures required. Elkins is the first uranium case construing the granting clause involved. In 1958 the Texas Court of Civil Appeals at San Antonio, in Cain v. Neuman, 316 S.W. 2d 915, no writ, held that a 1918 lease conveying "all of the oil, gas, coal and other minerals in and under" the land involved covered uranium. The lease provided a royalty of 1/10th on "other minerals." "We find no Texas precedent which discusses uranium," said the court, "but the usual arguments that uranium is not embraced within a lease are that the ejusden generis rule excludes uranium from the meaning of the lease

The application of other than mechanical methods to the study of the mechanical-physical properties of metals has become in the last few years a topic of investigation of ever-increasing interest, both from the theoretical standpoint and from that of the engineer and constructor. Besides the investigations which have been made of the magnetic properties of ferromagnetic metals, in their relation to the mechanical properties of these metals, which will be discussed more in detail below, there have been made studies of other phenomena in the same relation, and methods for the mechanical testing 'of metals have even been suggested; for example, the microscopic method of Tammann,' and the thermo-electric method of Turnera for determining elastic limits. The application of all such methods, which are based upon the dependence of some physical, crystallographic, or possibly chemical property, upon the mechanical state of the metal, must be preceded by close and careful correlation of these various "test" properties with the known mechanical state of the different metals or materials. It is with this view that the present work, as well as that of many previous investigators of, what may be termed in the interests of brevity, the mechanical-magnetic properties of ferromagnetic materials of construction, has been done. Previous Investigations of Mechanical Magnetic Properties The effect of mechanical stresses and of deformation, elastic or otherwise, oil the magnetic qualities of iron, steel, and other metals, has been studied by a number of investigators from the time of Joule (1841) to the present. It will, however, for the present purpose be sufficient to give an account only of the principal results obtained in the course of these investigations. Until a comparatively few years ago, interest in tantalum was limited almost wholly to its scientific investigation, but its extreme resistance to the action of even the strong mineral acids, its great avidity for the common gases, hydrogen, oxygen and nitrogen, and its capacity for transforming alternating to direct current are winning for it a place in our industrial life. Tantalum is not attacked by any single acid except hydrpfluoric, nor is it affected by solutions of alkalies. Aqua regia, which readily dissolves both platinum and gold, has no action on it. This resistance to the common corrosive agents is an outstanding property of tantalum and accounts for many of the applications to which it has been put. When heated, tantalum reacts readily with oxygen and nitrogen and absorbs large volumes of hydrogen, 740 volumes being taken up at a dull red heat. This capacity for absorbing gases is being utilized to an increasing extent in the manufacture of vacuum tubes, in which tantalum is used for the metal parts, especially for grid wire. It is said to be a superior metal for this purpose, particularly in power and sending tubes, because of its low secondary emission. The use of tantalum in the manufacture of electrodes, dishes, spatulas and other laboratory apparatus appears to be fairly steady. There has been some development in its use for dental instruments, surgical tools, pen points, hypodermic needles and acid-proof pumps. Recently it has been used in the manufacture of spinnerets for the rayon industry, of nozzles for the manufacture of artificial casings for sausages and of lining for plant equipment. Tantalum in Electrolysis It has been known for some time that certain substances permit the passage of an alternating current in one direction more readily than in the other. The early history of the mining and metallurgical industries of Pennsylvania is so intimately associated with the section of the State in which we meet, that a brief resume of a few of the important historical facts, and a reference to some of the more modern enterprises, in which members of the Institute have been largely concerned, seem appropriate to this occasion. It is just two hundred years since the publication of the earliest mention of the manufacture of iron in Pennsylvania. What kind of iron this was, or where or by whom it was produced, is uncertain. The only record of it is the following verse, quoted in the admirable work of Mr. James M. Swank,* from a poem published in 1692: " A certain place here is, where some begun To try some Mettle, and have made it run, Wherein was Iron absolutely found, At once was known about some Forty Pound." One who stood one hundred and seventy years ago on the summit of this Neversink Mountain † (had the atmospheric conditions been favorable, and the timber somewhat removed) might have noticed in the daytime the smoke, or at night the reflection, from the fires of the first successful Pennsylvania iron enterprises, scarcely 15 miles to the south, viz.: Rutter's bloomary forge, built in 1716, and the Colebrookdale blast-furnace erected in 1720, respectively 3 and 8 miles distant from Pottstown. Here the pioneers of iron production in the State which has so long led, and still leads all others in this manufacture, had their trials and successes ; and it may be a satisfaction to some who bewail a present depression in trade, and the low prices now ruling, to recall the fact that in 1731 pig-iron is reported to have been sold ''in large quantities" at the Colebrook-

EARLY in the development of every oil field, the operators of relatively large tracts of land must decide upon a spacing plan for the wells to be drilled upon their respective tracts. Usually it is desirable to have a system of regular spacing laid out over the entire tract, making such adjustments as may be necessary near land boundaries. Unless the dip of the producing formation is very steep, the equilateral triangular arrangement is the one most generally preferred, for the very good reason that it gives the maximum amount of drainage area for the wells up to the limit at which mutual drainage interference begins. Assuming that the equilateral triangular pattern is to be used, there still remains to he decided the matter of distance between wells. Many variable factors enter into the problem of proper spacing, some of which are physical and some economic. It is not the purpose of this paper to discuss these factors, as that has been done in several comprehensive articles during the past few years. In the end the decision must be based upon an estimate of the relative importance of various factors which apply to the field in question and to economic conditions in the oil industry at the time the development is getting under way. Even if the best possible spacing distance should be chosen when the problem arises, changing economic conditions and variation in physical conditions in different parts of the field may cause the original choice to become more or less unsatisfactory. Obviously, it is advantageous, once a spacing plan has been adopted, to avoid alteration of it as the field becomes better known or as conditions in the industry change, and yet be able to vary somewhat, the acreage per well in extending the area of development. Or, it may be desired to provide for an ultimate spacing considerably closer than conditions seem to warrant early in the development of the field. With these contingencies in mind, it is of interest to examine the possibilities which the equilateral triangular system affords. To quantify the effects of proper stemming on air-blast and flyrock reduction for a surface mining operation, a study was undertaken with funding from the Office of Surface Mining. Known weights of explosive charges were detonated in a simulated blasthole when confined with various types and size distributions of stemming. Results showed that proper selection of material type and size distribution can reduce necessary stemming length by 41 % and airblast levels by 23%. A relationship was obtained for minimum length of stemming for explosive confinement as a function of stemming size distribution and borehole diameter over a range of explosive pressures.

Pink Tennessee Marble was tested for wedge bit penetration characteristics at static and dynamic (10 - 250 ft/sec) loading rates. No significant differences were found within the dynamic range as far as the energy required to remove a unit crater volume and the force used to cause a certain penetration. Under static loading, however, both the energy and the force required were significantly lower. Tests run on bits of varying width indicated that as the wedge bit narrowed to an almost conical shape, the energy used per unit crater volume became considerably lower.

Vibration and air blast noise from blasting were evaluated during a research program sponsored by the US Bureau of Mines. Blast variables were studied wing small scale model (SCM) tests to evaluate specific variables as well as interactive effects, followed by experiments with production blasts at the surface coal mines. Experimental data showed that the primary variables affecting the ground vibration amplitude are the charge weight per delay and the length of delay interval. Blast variables having a significant effect on the overpressure amplitude include the charge weight per delay, the length of delay, burden and spacing, stemming amount and type, direction of initiation, charge depth, and amount of detonating cord and cover.

The oxidation behaviors of simple and complex chloride systems of copper, iron, nickel, cobalt, and manganese in a stream of oxygen were investigated using a thermogravimetric analysis technique. Their reaction mechanisms are discussed from stoichiometry, thermodynamic feasibility, and X-ray diffraction analysis of reaction products. The results are used to determine an optimum operating temperature of the selective oxidation step in a chlorination process for producing nonferrous metal chlorides, elemental sulfur, and ferric oxide from copper-nickel sulfide flotation concentrates.

A series of cross-hole acoustic measurements have been performed in a columnar-jointed basaltic rock mass around an underground opening mined by the drill-and-blast method. The purposes of the test program were: to evaluate the rock mass characteristics around the opening; to determine the zone of blast damage; and to evaluate seismic methods for anomaly detection ahead of mining in this type of rock. The cross-hole measurements were made between four 76-mm diameter horizon- tal boreholes diamond-drilled 12 m into a wall of the underground opening. Repetitive pulses of compressional (P) and shear (S) waves of frequencies in the range 3 kHz-100 kHz were propagated from a transmitter sonde through the rock mass to a receiver sonde, both of which were clamped hydraulically to the borehole wall. After amplification the received P- and S-wave signals were digitized at the surface by a digital oscilloscope and stored on floppy discs. The results indicate considerable reductions in P- and S-wave velocities at distances less than 2 m from the face. Clearly these low values are associated with blast damage. Beyond 2 m, the velocities in a vertical direction indicate almost constant values. The velocities in the horizontal direction beyond 2 m appeared erratic, but showed a general tendency to increase as a function of distance from the face. Their maximum values remained, however, still lower in value than the corresponding velocities in the vertical direction. Near the face, the differences in velocities were considerably greater: with horizontal velocities considerably lower in value than those vertical. Results of the spectral analyses of the received signals indicated that Q-values were strongly influenced by the vertically- oriented sets of joints. Only for waves travelling in the vertical direction was the effect observed of the blast-damaged zone immediately around the opening. The acoustic data obtained are clearly indicative of an anisotropic jointed rock mass, with a greater intensity of jointing for travel paths in the horizontal than the vertical direction. The vertical, columnar joints are probably less tightly closed than those oriented in the horizontal plane.

TELLURIUM has had the rare and unpleasant distinction of having fewer uses than any of the other common elements; indeed, it has had no regular or important uses. It is not only a useless and disagreeable element, but to the metallurgist it has been a nightmare. The interference of tellurium with the recovery of gold and silver from certain ores, as well as the difficulties it occasions in the electrolytic refining of copper, lead, and silver, are too well known to require enumeration here. In fact, the potential producers of the element have been quite willing to throw the crude products from which it might be recovered into the sewer. First isolated from a gold ore in 1782, although remaining a practically unknown element to the general public, it has long been a guiding star to the Western prospector in his quest for the "golden fleece." On the burning sands of the desert, in the frigid North, and in the mountain fastnesses of the more temperate regions of this and other continents, he has endured all manner of hardships in his search for tellurides; for where he found indications of tellurium, there he expected also to find rich deposits of gold and silver. This peculiar superstition, that tellurium, associates itself in nature with the precious metals, is not with-out reason, for witness the fabulously rich gold tellu-ride deposits of Cripple Creek and Western Australia. Selenium, the sister element of tellurium, which it resembles in many of its properties, was first isolated in 1817. It is found in small amounts in certain native sulfur deposits, and in many copper and silver ores from all parts of the world. Until a few years ago, selenium, like tellurium, was practically useless. The, unusual property of having its electrical conductivity influenced by light has long been known. Selenium cells, which for many years have been a scientific curios-ity, in the future may come to be of more commercial importance, but this use could scarcely absorb any large amount of the element.

As is well known, practically all the phosphorus of the ironores smelted in the blast-furnace passes into the pig-metal, increasing its fluidity, but diminishing its strength to such an extent that, if phosphorus exceeds a certain amount, the metal is only fit for fine castings, not required to resist strains, and it cannot be used for the ordinary purposes of good foundry-iron. No phosphorus being eliminated in the acid Bessemer process, the quantity admissible in pig-metal destined for that process must be very small, and hence the ores smelted must be strictly Bessemer ores, of which, in many districts, the supply is taxed to the utmost. On the other hand, very highly phosphoric pig, a metal of little or no value by itself, when refined by the Thomas-Gilchrist process in the basic converter, furnishes an excellent steel; but such pig-iron must be made from ores particularly high in phosphorus; and these ores are not everywhere abundant, and are much sought after for this special purpose. California's outstanding contribution to unit operation is the plan of development now established for the North dome of the Kettleman Hills. Beginning April 1, 1931, the Kettleman North Dome Assn. will control the unified operation and development of 10,800 acres of proven and semiproven oil land, and at the same time the Standard Oil CO. of California will operate as another unit its fee land of 9460 acres of similar character. The holdings of the two companies are in a checkerboard mile-square pattern. In addition to this, 410 acres of land may yet be included in the Kettleman North Dome Assn. unit and 530 acres of land are definitely out of both units. The owners of some of this land have expressed their intention of cooperating in a reasonable way with these two units. Cooperative agreements are now in force as to most of this field. Under the definitions of a unit pool and a near-unit pool,' the operation at Kettleman Hills will be a near-unit operation, but because of the size of the structure and its proven highly productive character, the arrangement. concluded on Jan. 31, 1931, in the approval of the Kettleman North Dome Assn. Agreement by Secretary of the Interior Ray Lyman Wilbur and by California State Oil and Gas Supervisor R. D. Bush is of outstanding importance to the entire oil industry. No other major unit operation plans are under way in California at the present time. There has been some little discussion of a plan in the North Belridge field and a feeling that the discovery of oil in the Lost Hills field and also in the South Belridge field would necessitate consideration of unit plans. So few data are available for these areas, as to the land that should be included in such unit plans, that little constructive action is now possible. The beginning of drilling on the Middle dome of the Kettleman Hills also makes it an area deserving consideration for unit operation. In 1974, iron pellet production in the Great Lakes region reached the 53-million-tpy level, accounting for more than 88% of the nation's pellet production. By 1978, pellet output from the Great Lakes district will climb to at least 78 million tpy. To achieve this 50% increase in output, the US iron and steel industry is investing at least $1.25 billion in new mines and pelletizing plants, mostly in Minnesota and Michigan. The biggest effort is concentrated in the Mesabi Range of Minnesota, the heart of the US steel industry's major iron ore source: here, plans for two new taconite plants-one by Hibbing Taconite Co., and the other by Inland Steel Mining Co.-and three major expansions of existing facilities are already under way to boost Minnesota's total iron pellet capacity from the current 41.2 million tpy to 65 million tpy by 1978. The facilities being expanded are those of US Steel Corp. (Minntac operations), Eveleth Taconite Co., and National Steel Pellet Co.
